you think this is bad, wait , this is his personal property and he does have the right to post no tresspassing signs and it is the law that he can protect his property. maybe if that dumbass cop had any sence he would have made that dumb cunt get the propper paper work and then come back . is this Russia/ wtf
@joker5972: You are yet another person spouting "the law".
Try actually READING the statutes, such as Indiana Code 35-41-3-2 (allowing force in CERTAIN situations defending property and 16-20-1-23 (allowing health inspectors to enter private property to investigate disease, after due notice).
@SuperTerryaki He was being sarcastic dumbass. He was pointing out the improper identification that she displayed as she was preparing to illegally enter his property. And honestly, crime is higher in cities so your comments about hillbillies and people who live in the woods having something to hide is so foolish.
@DavidForthoffer Your arguments make no sense. You cannot simply enter someone's property, in this case some sort of public official without a warrant when he has asked them to leave. That's basic common sense. I can't just walk around someone's property because I work for the Dept. of Public Health. Come on man. You have to have probable cause.
@CurtIs12367: Furthermore, if YOU worked for the Dept. of Public Health and had PROOF of a health code violation inside my HOUSE, probable cause would not be enough to just walk in. You'd need to get a warrant first.
The key is whether the area entered is protected by the 4th Amendment. Homes are. "Open fields" are not.
@DavidForthoffer Paying attention to strict law has always been a problem. But you are still going to get in trouble if you simply walk around someone's yards or fields. If you say refuse to leave a farmer's field, he can have the police come and remove you and likely arrest you. And I don't know why you keep citing the 4th amendment when all she had to do was get a simple warrant which would have completely satisfied this man.
@DavidForthoffer Also, Indiana Code 16-20-1-23 provides for searches for disease which she didn't mention. I feel like she would have known this law offhand had this been her actual intention.
if it was so important she should have obtained a warrant then she would have been legal.just b/c some overweight goofball has a gun on his hip and a tinstar on his chest doesnt make him RIGHT!!
@coalminer24605: As far as we know, she DID enter his property legally, pursuant to Indiana Code 16-20-1-23, which allows health inspectors to enter private property to investigate disease, after due notice. And since she only entered areas not protected by the 4th Amendment, she did not need a warrant. She WAS IN THE RIGHT (if she gave due notice, which I think she probably did).
so when you go on a persons posted property and you get arrested for tresspassing the law unlawfully arrested you ????? you cant go onto peoples land without a warrant. like i said it isnt about having something to hide it is rights of a citizen. when you let the government intrude one footstep tey will take ten!!
@coalminer24605: If you go on a person's posted property and you get arrested for trespassing, you ARE lawfully arrested, even if you have not violated the person's 4th Amendment rights.
You say "you cant go onto peoples land without a warrant." Not so. The 4th Amendment only constrains GOVERNMENT AGENTS, not private citizens.
Try to understand the difference between 4th Amendment rights and rights against trespassers.
@DavidForthoffer "the 4th amendment only constrains GOVERNMENT AGENTS, not private citizens?" you base this on what exactly? the 4th amendment doesn't mention government agents or private citizens. haven't you seen the video where the ASPCA guy (private citizen) threatens to get a search warrant when the land owner refuses to let him enter his property in New Hampshire?
@chieftp: The U.S. Supreme Court has held, "It has, of course, been settled since Burdeau v. McDowell, 256 U. S. 465, that a wrongful search or seizure conducted by a private party does not violate the Fourth Amendment".
I'll believe the U.S. Supreme Court. You can believe whichever ignoramus you want. Why, some folks out there actually believe the 4th Amendment protects ALL property!!!
@coalminer24605: First, you are confusing rights against trespassers with 4th Amendment rights. They are completely unrelated. You have 4th Amendment rights in your tent even while you illegally camp on someone else's property. On the other hand, police can search your cornfield for contraband without violating your 4th Amendment rights at all. Merely owning private property does not give you 4th Amendment rights over all that property (except for the "home" portion).
@coalminer24605: Second, the 4th Amendment only protects "persons, houses, papers, and effects". It does not protect the areas she visited here. She did not violate his 4th Amendment rights.
BOTH SHOULD HAVE BEEN ARRESTED !!!! THIS ISNT NAZI GERMANY THIS IS THE UNITED STATES OF AMERICA!!! THE CONSTITUTION SAYS NO ILLEGAL SEARCH OR SEZIURE!!!!!! THE NEED A WARRANT!!!! HE SHOULD HAVE GRABBED HER BY THE HAIR AND THREW HER OUT IN THE ROAD!!!
@coalminer24605: You sound like yet another person who believes the 4th Amendment protects ALL property against search of seizure without a warrant. It does not. It only protects "persons, houses, papers, and effects".
If the videographer had grabbed her, he would have no doubt found out why the deputy was there.
Freedom from unreasonable searches: The government may search and seize Americans' papers and effects without probable cause to assist terror investigation.
Judas Lloyd. Calm down. You know the Constitution so well, yet you live in a trailer house. If you know the Amendments so well, get a degree and get a house.
Who exactly filmed this? I heard him say Laporte County. I am in Elkhart County and am interested in talking with like minded People who know who they are. Share ideas, knowledge, etc...
Too bad it was dismissed...Sometimes it can be settled with a monetary amount. But dismissed means that the court refused to even hear the case. Too bad. This makes me want to become a Judge, so I can uphold this BS. The cop knows what he is and is not supposed to do, but this woman doesn't understand.
@DavidForthoffer That Bitch was told not to enter his property and she didnt have a warant and that Pig should have stopped her from going on his property.
@joetubealong: You sound like yet another person who believes the 4th Amendment protects ALL property against searches without a warrant. It does not. It only protects "persons, houses, papers, and effects". Since she did not search any of those, she did not need a warrant.
Since Indiana Code 16-20-1-23 allows health inspectors to enter private property to investigate disease, after due notice, she MAY not have been trespassing.
@DavidForthoffer From what I could dig up on this situation you're right, both the inspector and the officer were within their rights. Apparently this man was setting up some kind of illegal sewage system that drained into a neighbor's well. This went to court, he lost, and he ended up having to sell his property to cover the fines
I hope you did sue them. You are absolutely correct that they had no right to come onto your property. People have become accuntomed to just allowing authorities to do whatever they please. We will continue to forfeit our rights until more people do exactly what you have done. Thanks.
@comingforya1: Yes, there IS such a club. It is called Indiana Health Inspectors.
The catch, aside from proving yourself competent for the job and actually getting the job, is that you have to either give "due notice" to a homeowner explaining when and why you will be inspecting their property, or get a warrant to do it. But then you would only be trespassing in the eyes of the homeowner, not the eyes of the law, because of Indiana Code 16-20-1-23, et al.
What the hell is she taking pictures of? Your property ?Your stuff, what your doing on your own time your own property of which you have all rights to tell who is and is not allowed on. Wow i have a new name for her, Stupid ass bitch, that fits well.

...seems the USA came away from WW2 with more than just a victory... Washington D.C., BOTH parties, some states and [localities] simply picked-up where the NAZIs had left off! Where do you folks think those... (Known-in-Europe) Nazi/Vichy/Fascist/Gestapo/SS- Party activists/perfunctories, intelligentsia(educators/artists[all subjects thereof both] doctors, professionals(NAZIs put the USA on th' moon)...mostly went? They began to teach and entertain and re-structure politics in the USA and UK!...
Even though this guy is a little over excitable, I can understand he is emotional over what HE perceives to be a violation of his rights. I empathize with him and I agree the statement the officer made 'if you do not have anything to hide...' etc is just a rediculous power tactic to get the guy to agree. However, if there is a concern about whether what he is doing is legal or not and it is being done in clear view from outside the property line, the police DO have a right to investigate
@mustamissdher: Two issues. 1. Was she trespassing? Although Indiana Code 16-20-1-23 allows health inspectors to enter private property to investigate disease after due notice, we do not know whether she gave due notice, so we don't know whether she trespassed.
2. Did she enter curtilage? Curtilage is defined by the U.S. Supreme Court in United States v. Dunn (1987). From reading that, she clearly did NOT enter curtilage.
@mustamissdher: But note that your principle is NOT correct. You are misstating the Plain View Doctrine, which says that if an officer sees CONTRABAND inside a home's protected curtilage AND if the officer has a right to enter where the contraband is (e.g., by walking from the road up the path to the front door) then the officer may seize the contraband.
If the officer does NOT have a right to enter there, the officer must get a warrant, and seeing contraband there is a good reason for that.
@matthias19850: Not so. As the U.S. Supreme Court confirmed in United States v. Dunn (1987), an officer needs a warrant to enter curtilage, absent consent or exigent circumstances.
Probable cause of some crime is NOT exigent circumstances and is not sufficient.
Exigent circumstances include walking the natural path from the public road to the obvious front door, hot pursuit of a felon who knows he is being chased, preservation of evidence in imminent danger of destruction, personal injury...
Julie W. with NO last Name..you are a Public Servant and were WARNED to get a Warrant or get the Hell off this Private property. Get your GUNS and LOAD them Amerikka, you have a RIGHT to Take down Tyranny and that IS why our ForeFathers GAVE US this right. Our land is GOD given not corrupt gov't officials to DO WHAT THEY WANT.
So, what is the outcome? Did you sue? Did you win? Are you richer?
He may be over-reacting a little, but so would I if someone entered my home without a reasonable cause to be there. You are a genious recording the entire thing and getting names. Tell us how you made out.
This cop is a fucking spineless shitbag to ask "Do you have something to hide?" and "Why would she need a warrant?"
He's there to serve the public, and protect the peace. Stomping on this property owners rights is a disrespect to anyone who has ever fought to protect the freedom of U.S. citizens. People have died so that we can call ourselves free, and to make a mockery of this idea is to make a mockery of our nations heroes.
Your screwed as all of us in Indiana..... That's to the Indiana State Supreme Court, police now have the right to enter your property irregardless if they have a reason or not.... :(
6:30 and here comes the grand finale of his melodramatic schizophrenia paranoia anti-government conspiracy theory laden comical performance of the day: "I was afraid for my life and for my safety today, you let this woman just walk on my property because you think that she has the right." Considering that this guy is living in a trailer in the middle of nowhere, maybe he wont mind being a hermit. I know as a mailman that I would never, ever deliver there. He wouldn't have cable, either.
6:00 lol he gives the officer shit the whole time with his randy weaver sociopathic bullshit and then when the lady walks on his property he begins begging like a spoiled 4 year old that the officer do something about it. The irony is incredible. Maybe I ought to pull this with the meter reader. Man, it's amazing this guy isn't committed to a nuthouse. A guy I went to school with is in outpatient commitment with forced drugging and he was saner than this guy. Would hate to be his mailman.
This is what happens when you read some old libertarian propoganda books and let them supplant your common sense. In MI, and I'm sure indiana as well, any worker - government or not, census or mailman or cable guy - has a right to enter your property UNTIL you tell them to leave, and ALWAYS an officer ON DUTY never has to exit your property when told. This guy could have been arrested for obstruction, and whatever else the cop could had figured. Around here he would have got his crazy ass beat.
Man this crazy guy is so lucky he's dealing with an asleep-at-the-wheel, middle-of-nowhere cop. Raising your voice at a police officer can get you arrested AND prosecuted no matter where you are, refusing to comply with an officer can get you busted on obstruction at the very least. It doesn't matter if the cop has a right to do this or that, that's for the courts to decide much later in the future. By law you have to surrender to police authority whether they are violating your rights or not.
@cornsnoggle She doesn't, but he's a paranoid schizophrenic libertarian. The sort of people who act like they are being anally raped while their children are kidnapped and trafficked to india as slave laborers whenever somebody asks them for their I.D.
What the fuck is with these crazies. They make shizos and the tuscon shooter look like normal guys you could eat at a restaurant with. I'd love to live near this guy so I could just fuck with him all the time and give him shit every time he leaves his precious property. I'd try to bait him to pull a gun and then have him busted for it. In MI at least, it's a serious crime to draw a gun at a trespasser unless the trespasser is armed. I'd bait the fucker into doing it by aggravating him.
Oh my fucking god, I just looked the case up and this dumbass eastern hick installed a homeade septic system that fucked his neighbors up and he dare has the balls to rant and rave about his rights. And to the "Just shoot them, they're fair game" that's not true. There are only few places, texas for instance, where you can legally shoot a trespasser on your property under certain circumstances. Even then you have family and vigilante's to deal with. People don't take kindly to killers.
@M1thotyn i understand your comments and agree with much of it (and fyi, my original comment that you replied to was supposed to be sarcastic). i do think that you're wrong, however, in your statement that an officer does not have to leave your property, even if ordered to do so. in the legal poli sci classes that i've taken, we've learned that the 4th amendment has had a number of "yes, but..." decisions made by the supreme court. an officer may not enter your property if they've been...
@nicolassoleil (part 2) ...told that they are not welcome by the owner or legal occupant of the property. exceptions are when the officers has a warrant or sufficient reasonable cause to override the occupants 4th amendment rights. if they officer in the video was worth his weight in manure, he would have explained that to the nutjob.
@nicolassoleil He is not a nutjob because he wants her to not be there, it is his property not hers or the sheriffs. He was in the right and they broke the law. Period
@lupinyonsei It's posted more than several times in the comments for this video. Just look for them. I still cant get over the audacity of this asshole. He thinks that what he's doing on his property is nobody else's business. Bullshit, if some braindead schizophrenic asshole is building shit and especially putting in his own septic system in my neighborhood that's by and far my business. I used to be a libertarian, until I lived in the real world for awhile and now I cant fucking stand them.
@lupinyonsei Just think of it this way, and expand it to any sort of anything that people do with property. If he fucks up and cant afford to have professionals fix it and I'm his neighbor, who then has to deal with it? Me. Who eventually has to pay to get it fixed? Me. So then, how is it not my and the whole neighborhoods business?
@M1thotyn if he fucks up what?! from the video she doesn't say anything and why she wants to get on the property. you know what she could have done? walk into his house and rummage through all his belongings as well. there didnt seem to be any proof of anything which is why i think what she did was wrong. again if you could provide the article, that would solve everything. no "hypothetical situations" please
@lupinyonsei I already told you, and a quick 5 second scam of the comments would have told you again, indianalawblog(dot)com/documents/072806nfp{dot}pdf
@lupinyonsei And I didn't say he fucked up the septic system, I said *IF HE DOES* then *I HAVE TO PAY FOR IT* ! Which makes it *MY BUSINESS*, not only would I be smelling his shit, but when this obviously shizophrenic r-tard in his manufactured home cant afford to fix it, who has to spend the 15k to save his property value? ME! This is why we have things like building laws and zoning ordinances. What you do on your property affects others, so it's not just your business.
@M1thotyn if he fucks up what?!?! she didnt mention anything so why are u mentioning about a septic tank? can u please show the article your talking about. she did not state a reason. she just walked in. no evidence of a septic tank is shown. so why are you talking about a HYPOTHETICAL world where this guy IS having a septic tank built?
@lupinyonsei *shrugs* for crying out loud will you just google "Raimundas Kirkus" / "whatever" and find it for yourself! I'm not your internet chauffeur. Try "Raimundas Kirkus evicted" or "septic" or whatever. I found a hundred things last time I did. Apparently, the guys homeade septic tank was leaking into his neighbors water supply and he got evicted.
Good for you buddy!! This is so typical of how americans are treated now. They are so in the wrong and whether or not he has been doing some illegal construction or not the state should be in some serious trouble. Stupid woman.. And thanks you John law for doing such a stellar job.
I'm going into law enforcement, but, I SUPPORT YOU 100%, YOU ARE 100% RIGHT! I HOPE YOU LIVE IN A MANSION! BTW, she did tresspass, but you can't force her to delete the pictures she took b/c they are the states property, however with the trespassing they are inadmissable in court. (Not that this is relevant, but that's my birthday.) 5* to you.
It makes no difference if she suspects criminal activity. If I were to let myself into your house, car, your wallet/purse just because I (John Q citizen) believe you are involved in"criminal activity", would you let me do that?????????? HELL NO!!! It's private property - apparently alot of you don't own property. If she were to enter the property & get hurt just "lookining around" he WILL be liable. It's his right to defend & to protect himself & his property. She IS lucky!!!
BTW, do you have the right to use physical force on your property in your state?
I understand the concern of people saying "it's for the community", but the guy in the video is right. They must have documentation to lawfully come on to your property. If they would go get a court order, then okay. But they just show how the government will push people around and ignore the constitution.
This guy is a douche what we call in retail a high maintenance customer. Got lots of freinds in law enforcement who deal with assholes like this who think the law does not pertain to them. I don't agree with every law or rule but we need to follow them. When you break them pay the penalty like a man and stop whining. Bet this guy is like the nut my cousin David encountered at the UP yard in Houston. He tried to say his autorack rail cars were really FEMA Human Cattle Cars.
@UnionPacificBNSF So those who feel they they should assert their RIGHTS are "high-maintenance customers?" This guy (you) are a douche who accels in your art. Your previous comment applauds unconstitutional violence and even deadly force - I'm glad that's your judgement call even though there was NILL physical conflict in this video, just a man verbally defending his homestead. Fuck you, you dumb grunt. Thanks for perpetuating my piss-poor opinion of Texas, thanks to your demigod Bush Jr.
i wouldn't have let her take any pictures, i would have jumped in front of her camera everytime, until the cop decided to join in. They think they are above the law, fuck them all!!!!
... this is an issue with the zoning ordinances or variance of LOCAL laws-
This is a CIVIL matter; NOT CRIMINAL ! The course of LEGAL action is for her to notify her superior(s) of an ALLEGED noncompliance and THEN to, by notification,[The US Mail] alert this citizen to the issue and a date be set for an inspection.
Yes Veronica,Gov't personnel and cops MUST follow legal departmental procedeures which DON"T VIOLATE FEDERAL/NATION-WIDE LAW!
NO local CIVIL ordinance over-rides the Constitution!
@Sodiumreactor... you just won't get it. A guy who doesn't stand up for what are his RIGHTS becomes a docile PUPPET for what ever political hack that comes along!
You have absolutely no idea what "Probable Cause" means. 'Officially' or in the courts.
Political naivete' makes it easy for creeps that come along & go to the spoil of a nation for cause those rightful citizens NEVER stand up & refuse these enemies of our Constitutional Democracy the enactment of their tyranny. Way too much tv, pal
this is absolute bullshit, I hope you got a big fat settlement from the state. They have absolutely no right to be on your land, I think if this happened to me on my land I might seriously consider shooting them....because they are from some bullshit government agency doesnt give them the right to enter your property without permission. Fuck this non-sense
Look pal, if your doing some kind of excavation work on your property, or she sees something that she considers "probably cause", she can come on the property. So quit crying about it. You have two choices: vote for different county leaders, or move out of that county.
... do not EVER forget: The Constitution of the United States is a constant slap-in-the-face to Britians' royals. The best I can figure is Marxism[communism] was ALLOWED to exist by the Brit royals as a means of keeping English merchants under control-can't have businessmen becoming more wealthy than the King, now can you?! America is a REBEL nation to them(royals) and ALWAYS shall(i hope)be.
Marxism is a nasty little bit of the Royal 'Revenge' sent our way for the troubles our Founders caused
... by acting as he did the cop violated his Oath negating his PRIVELEGE to be a cop in the first place- the bitch; she's merely an agency whoe. To be short: I'm through, completely done w/these American Nazis and i'll fight to the death; As my father and uncles did during WW2- those fucking nazis(socialists) and communists who've been pouring into the US ever since the 20's!! That bitch is one of the 'products' of EUROPEAN[British] Marxism: A direct overthrow of the US Constitution! This IS war
@SittingMooseShaman Im a brit and I TOTALLY agree with you! I had a slight 'run in with some asshole cops last night............they try the old intimidation routine, but it don't work on me! And don't they just HATE it when they can see they won't get the better of a person!!!
The guy owning the property has an attitude problem and comes across as though he has something to hide. If I dug up my property like he did with the backhoe, I would be fined.
Laws - A few years ago my ex filed charges on me.. I was protecting my children when the law did nothing but alow youg children to spend the night with men.. It was dismissed in court with all the evidence, including sheriff allowing it, and other witnesses... I'm not sure force can be used in all states, I did not use force to kill, just tried to stop it. Be very carefull before force is used and MAKE sure it is in the act of protecting life.
You dont always need a warrant, but you do need PC.If you have PC to search, a warrant is not required. If you get consent its ok to search. If you can articulate exigent circumstances you can search as well (to prevent destruction of evidence). I take it this woman is a health inspector? Who knows. We didn't exactly get the full story from Mr. "I know my rights"
On another note, I'm surprised by comments of those who say they would physically hold the woman, then shoot her.
sounds like to me they stated they were investigating a health violation complaint, they both identified themselves....should have locked his ass up for obstruct and delay.
So I went into this school today conected to the Ymca to get my sweather I left in after this dance the night before and an alarm went off and I think theres a camera in there. Will I be charged if I get cought?
She provided no written proof of a signed court order. It was his right to refuse her to enter his property since he had not violated the law. LAWSUIT!
thats some bullshit, the same ole fucking line "if you don't have anything to hide", man fuck that i would have had my 12 gauge in one hand and the camera in the other hand. Everyone has rights and this guy is doing everything right. Stand up for your rights. That is some fucked up shit for the cop to let her do that. You should have beat that bitches ass
I was just arrested yesterday for "Criminal Trespassing", and I'm 16. XD It was funny though, because, when the police officer took off my handcuffs he asked, " You're not going to harm me in anyway are you, ma'am?" LOL I said, "I have the right to remain silent!"
Fuck that cop and the woman. Who the fuck are they to say that a person should give up their constitutional rights and allow them to conduct searches without warrants.
you cannot cross even if there is no fence, she does need a warrant to be able to trasspass his property line. he couldve have the sheriff arrest her if she didnt cooperate!
Some of you idiots are lambs for the slaughter. This chick has NO right to enter his property without rightful authority. The cop is an idiot as well, he should know his job and encourage the lady to get a warrent or whatever she needs. Give a gov. employee an inch and they take a mile.
It's not socialism, it's the savage capitalism of the United States. That girl was just doing her job even when her job wasn't required. Seems to me that homestead was pretty far off the beaten track. I wonder what the real story is? The state of Indiana must have a target there for some reason. Natural gas maybe?
just fuking shoot the noisy bitch

Try to understand the difference between 4th Amendment rights and rights against trespassers.
DavidForthoffer 1 month ago

DavidForthoffer 1 month ago
this is private property. what is the problem with the US is people are afraid to stand up to NAZI germany !!! she has no right without a warrant!!
coalminer24605 1 month ago
@coalminer24605: First, you are confusing rights against trespassers with 4th Amendment rights. They are completely unrelated. You have 4th Amendment rights in your tent even while you illegally camp on someone else's property. On the other hand, police can search your cornfield for contraband without violating your 4th Amendment rights at all. Merely owning private property does not give you 4th Amendment rights over all that property (except for the "home" portion).
DavidForthoffer 1 month ago
@coalminer24605: Second, the 4th Amendment only protects "persons, houses, papers, and effects". It does not protect the areas she visited here. She did not violate his 4th Amendment rights.

@coalminer24605: You sound like yet another person who believes the 4th Amendment protects ALL property against search of seizure without a warrant. It does not. It only protects "persons, houses, papers, and effects".

Since Indiana Code 16-20-1-23 allows health inspectors to enter private property to investigate disease, after due notice, she MAY not have been trespassing.
DavidForthoffer 2 months ago
@DavidForthoffer From what I could dig up on this situation you're right, both the inspector and the officer were within their rights. Apparently this man was setting up some kind of illegal sewage system that drained into a neighbor's well. This went to court, he lost, and he ended up having to sell his property to cover the fines

DavidForthoffer 4 months ago
@comingforya1: Yes, there IS such a club. It is called Indiana Health Inspectors.
The catch, aside from proving yourself competent for the job and actually getting the job, is that you have to either give "due notice" to a homeowner explaining when and why you will be inspecting their property, or get a warrant to do it. But then you would only be trespassing in the eyes of the homeowner, not the eyes of the law, because of Indiana Code 16-20-1-23, et al.

Even though this guy is a little over excitable, I can understand he is emotional over what HE perceives to be a violation of his rights. I empathize with him and I agree the statement the officer made 'if you do not have anything to hide...' etc is just a rediculous power tactic to get the guy to agree. However, if there is a concern about whether what he is doing is legal or not and it is being done in clear view from outside the property line, the police DO have a right to investigate
mustamissdher 6 months ago
@mustamissdher: Two issues. 1. Was she trespassing? Although Indiana Code 16-20-1-23 allows health inspectors to enter private property to investigate disease after due notice, we do not know whether she gave due notice, so we don't know whether she trespassed.
2. Did she enter curtilage? Curtilage is defined by the U.S. Supreme Court in United States v. Dunn (1987). From reading that, she clearly did NOT enter curtilage.
DavidForthoffer 6 months ago
@mustamissdher: But note that your principle is NOT correct. You are misstating the Plain View Doctrine, which says that if an officer sees CONTRABAND inside a home's protected curtilage AND if the officer has a right to enter where the contraband is (e.g., by walking from the road up the path to the front door) then the officer may seize the contraband.
If the officer does NOT have a right to enter there, the officer must get a warrant, and seeing contraband there is a good reason for that.
DavidForthoffer 6 months ago
@DavidForthoffer Officer, not health inspector.
matthias19850 5 months ago
@matthias19850: I don't understand the context you're referring to.
DavidForthoffer 5 months ago
@DavidForthoffer An officer may enter with probable cause. However, a health inspector does not carry the same authority.
matthias19850 5 months ago
@matthias19850: Not so. As the U.S. Supreme Court confirmed in United States v. Dunn (1987), an officer needs a warrant to enter curtilage, absent consent or exigent circumstances.
Probable cause of some crime is NOT exigent circumstances and is not sufficient.
Exigent circumstances include walking the natural path from the public road to the obvious front door, hot pursuit of a felon who knows he is being chased, preservation of evidence in imminent danger of destruction, personal injury...

M1thotyn 9 months ago
6:00 lol he gives the officer shit the whole time with his randy weaver sociopathic bullshit and then when the lady walks on his property he begins begging like a spoiled 4 year old that the officer do something about it. The irony is incredible. Maybe I ought to pull this with the meter reader. Man, it's amazing this guy isn't committed to a nuthouse. A guy I went to school with is in outpatient commitment with forced drugging and he was saner than this guy. Would hate to be his mailman.
M1thotyn 9 months ago
This is what happens when you read some old libertarian propoganda books and let them supplant your common sense. In MI, and I'm sure indiana as well, any worker - government or not, census or mailman or cable guy - has a right to enter your property UNTIL you tell them to leave, and ALWAYS an officer ON DUTY never has to exit your property when told. This guy could have been arrested for obstruction, and whatever else the cop could had figured. Around here he would have got his crazy ass beat.
M1thotyn 9 months ago
derp, why does she need a warrant
cornsnoggle 9 months ago
Man this crazy guy is so lucky he's dealing with an asleep-at-the-wheel, middle-of-nowhere cop. Raising your voice at a police officer can get you arrested AND prosecuted no matter where you are, refusing to comply with an officer can get you busted on obstruction at the very least. It doesn't matter if the cop has a right to do this or that, that's for the courts to decide much later in the future. By law you have to surrender to police authority whether they are violating your rights or not.
M1thotyn 9 months ago

@M1thotyn i understand your comments and agree with much of it (and fyi, my original comment that you replied to was supposed to be sarcastic). i do think that you're wrong, however, in your statement that an officer does not have to leave your property, even if ordered to do so. in the legal poli sci classes that i've taken, we've learned that the 4th amendment has had a number of "yes, but..." decisions made by the supreme court. an officer may not enter your property if they've been...
nicolassoleil 9 months ago
@nicolassoleil (part 2) ...told that they are not welcome by the owner or legal occupant of the property. exceptions are when the officers has a warrant or sufficient reasonable cause to override the occupants 4th amendment rights. if they officer in the video was worth his weight in manure, he would have explained that to the nutjob.

M1thotyn 7 months ago
@lupinyonsei Just think of it this way, and expand it to any sort of anything that people do with property. If he fucks up and cant afford to have professionals fix it and I'm his neighbor, who then has to deal with it? Me. Who eventually has to pay to get it fixed? Me. So then, how is it not my and the whole neighborhoods business?
M1thotyn 7 months ago
@M1thotyn if he fucks up what?! from the video she doesn't say anything and why she wants to get on the property. you know what she could have done? walk into his house and rummage through all his belongings as well. there didnt seem to be any proof of anything which is why i think what she did was wrong. again if you could provide the article, that would solve everything. no "hypothetical situations" please

Totally should have beat the crap out of that lady!

She provided no written proof of a signed court order. It was his right to refuse her to enter his property since he had not violated the law. LAWSUIT!

He should win the lawsuit. They had no right to eneter or remain
jonf1023 1 year ago
thats some bullshit, the same ole fucking line "if you don't have anything to hide", man fuck that i would have had my 12 gauge in one hand and the camera in the other hand.

So... did you file a report?
GuitarReenact30 2 years ago
Should have called the state police and reported the trespassing cop and women.

Fuck that cop and the woman. Who the fuck are they to say that a person should give up their constitutional rights and allow them to conduct searches without warrants.
combo2xtrapickle 2 years ago
this sheriff sucks , if i was the owner i take out my gun and make her leave!
usaamerica1 2 years ago
you cannot cross even if there is no fence, she does need a warrant to be able to trasspass his property line. he couldve have the sheriff arrest her if she didnt cooperate!

Some of you idiots are lambs for the slaughter. This chick has NO right to enter his property without rightful authority. The cop is an idiot as well, he should know his job and encourage the lady to get a warrent or whatever she needs. Give a gov. employee an inch and they take a mile.

No doubt...!! She wouldve had to get by my smith and wesson 500 b4 she set foot on my property. Welcome to the socialist united states.
willclymer 2 years ago
It's not socialism, it's the savage capitalism of the United States. That girl was just doing her job even when her job wasn't required. Seems to me that homestead was pretty far off the beaten track. I wonder what the real story is? The state of Indiana must have a target there for some reason. Natural gas maybe?
snowballandsmokey 2 years ago
Kebtboy05, you're an idiot. Whether or not he had anything going on that was wrong is not the issue, that arrogant little broad MUST have a warrant.

I would have physically removed that dumb city slicker tree hugger bitch myself ...
