  • @24017460 Not ture, I've been stopped by customs for carrying large amounts of cash, and by explaining the reasons why I was doing that and not behaving like an arse quoting the law and all this nonsense, they let me on my way in under 3 minutes. If I had starting quoting laws, cases and trying to arrest the HMRC officers, I would have probably have had my money seized and would have needed to appeal to get it back.

  • @ivanleo But the law is set in stone. You can go on your way regardless. They have no right to detain you. They have no right to question you. "For the sake of public interest" and "reason to believe" when there is no reason to believe and the law isn't followed to the letter is why the criminal justice system in the UK is a complete and utter farce. That applies to immigration, criminality on the streets and court proceedings in local areas. The law is where the buck stops. Simple as that. =D

  • @RichieDee123 Whether there is a reason to believe or not is ultimately determined by the court. Sure, you can just take your chances and resist what you believe to be a wrongful arrest by force, but if the court finds against you, you're in a load of the brown smelly stuff. And even if you win, being arrested, searched, remanded or bailed, going to court and arguing your case is a lot more hassle than cooperating in the first place.

  • @ivanleo Yes, but then why do courts give the right to ignore the "requests" to begin with if it can be ignored? If the rights exist, people should be allowed to exercise them. Rights are given by law and even laws exercised by law. Like I said: You can't pick and choose between laws or rights when it suits you. And if you read the link that is offered here, it states in black and white that the official needs to have written in a notebook a reason for the stop. Assumptions are not reasons.

  • @ivanleo You were born here and given certain rights for a reason. Every UK citizen is given such rights when the law is applied. There's no working around the issue. If the UKBA officials and immigration officers learned for the job properly and knew the law to the letter, the situation would have been over within minutes, maybe even seconds. Failure to be prepared or being lackadaisical on the job is inexcusable. It impacts on people's lives. Don't read the riot act 'til you've read it. ;-)

  • @ivanleo Preaching "comfort" or "speed of service" over law is not how a country's run, even when it comes to random passenger stops. And for me, as I'm hoping to become a police officer, the people who take the piss when it comes to the law is astounding, 'cause leniency is given over strict and stringent rules. If the man knew his rights, I think the people should've bitten their tongues and kept quiet and let him on his way, since they were in the wrong to begin with.

  • @RichieDee123 I'm not arguing that anything is right or wrong, I'm just saying that for the sake of convenience I would rather just answer their questions as I have no time to argue with people over the finer points of the law. If you want to take a different approach then you crack on.

  • @ivanleo Yeah, but when you see the state of the law these days in the UK, I think "rights" have trumped "law" and that's what the inherent problem is. It's refreshing to see someone actually distinguish between both and actually explicitly express both in the correct manner. This man should be commended. Most people wouldn't have had a clue. And if we're going to progress as a nation, it'd be helpful to know we have the right people in the right jobs knowing what they should be doing.

  • @KingsWorld2010 Never been bullied by UKBA in my life, on the contrary they always seem quite appreciative to not be spoken to in a hostile manner. They get crap from members of the public all the time, being courteous and polite goes a long way with them.

  • @ivanleo If anyone just rolled over and complied to custom's officers or indeed any kind of "charge" given by an authority in the UK without exercising their given rights, it'd simply be a flawed and useless system. There'd be no point creating these rights to begin with. Democracy would be a thing of the past. The UK would cease to exist. Lol. I'm not being pedantic or too big-headed, I just think that if you make rights available, you allow them to be exercised. This man did that well.

The Government of Britain is only interested in being in Europe when it suits them but they can't have it both ways, we are either in Europe or we are not. Going to Europe for tobacco is not a criminal offence it is common sense. With anything you buy you go to the cheapest place, its not rocket science.
