1: If you're 'insane', you aren't guilty. That's the whole point, that you're unable to distinguish right from wrong (or unable to act upon it)
2: Assuming he was insane (temporary or permanent), he'd be committed. This has no time for release. Release only happens if there's no threat to society.
3: It's a tied system. My ward is for the newest prisoners, complete lockup. Then they move down into less restricted wards, eventually into...
the cottages (think a share house). The last step is a CTO (community treatment order), which is 'back in public' with certain restrictions on a case by case basis.
4: The average time from my ward to CTO is 15yrs, but some are never released.
5: Our patients are predominantly ASP ('sociopaths').
6: The medications are titrated. We start with a 'heavy' dose, than lower it over time unless they become violent/dangerous.
The system is NOT perfect. Because of low funding, we often have to 'shift down' faster than we like. That is, my ward has 31 beds. A correctional facility just isn't enough. That guy with respect to the security of the citizenry should be put in Jail for 10-15 years and have psychiatric evaluations periodically and then sent to a corrections facility. So I guess I agree with the guy on this one. But damn Ana scared me at first just when she said "I think it's wrong that they're putting him in jail."

As a nurse that works in a forensic psychiatry ward.
1: If you're 'insane', you aren't guilty. That's the whole point, that you're unable to distinguish right from wrong (or unable to act upon it)
2: Assuming he was insane (temporary or permanent), he'd be committed. This has no time for release. Release only happens if there's no threat to society.
3: It's a tied system. My ward is for the newest prisoners, complete lockup. Then they move down into less restricted wards, eventually into...

the cottages (think a share house). The last step is a CTO (community treatment order), which is 'back in public' with certain restrictions on a case by case basis.
4: The average time from my ward to CTO is 15yrs, but some are never released.
5: Our patients are predominantly ASP ('sociopaths').
6: The medications are titrated. We start with a 'heavy' dose, than lower it over time unless they become violent/dangerous.

The system is NOT perfect. Because of low funding, we often have to 'shift down' faster than we like. That is, my ward has 31 beds. If we have 31patients (which is about 99% of the time), and we get a new patient come in, we have to shift our 'best' patient down the line. That then keeps pushing all the way to the cottages.
Release onto CTO is governed by the review committee, made up of a psychologist, psychiatrist, representative of the gov, a community member, and their case mgr nurse.

There are forensic prisons for people who are mentally ill criminals. He might be going there to serve his sentence. They may keep him longer if he seems dangerously ill. I imagine the 10 years probation is to track him and make sure he's not a threat to the community. Must have been pretty horrendous what happened to him, but I also think we have to protect society, too.

Self defense only applies if your life is being threatened in the moment. You can't be threatened, get away, then go back later and kill someone in "self defense".
Then you have to inform the police of what happened immediately otherwise it shows criminal intentions. (People who truly kill in self defense have nothing to fear because they know they didn't do anything wrong.)
Emotional pain is no excuse for murder. If that were the case most murderers should be set free.

I'm dumbfounded that he's getting 3 years, and 5 years is still too little. The guy was raped, yes, and I'm sorry to hear it, but your actions speak louder at the moment.
