I am all for right and personal responsibility but in this case YOU MADE A CONTRACT FOR THE REPAYMENT FOR THIS LOAN. YOU did not live up to your responsibility to pay the money you owed. I have just lost respect for this channel. Be free live your life and be free. You signed the contract and made a deal to pay back the money. In this case YOU ARE WRONG. YOU MADE A DEAL! Be responsible for your self.
a bank's claim on a house should not legally extend to any small items around or in the house. Those are easily the owned property of the PERSON not the bank, except for things like furniture which may be on payment/loan with ANOTHER company (such as The Brick). In which case the bank and the police are stealing. STEALING. Illegally.
pay your fucking bills and this wont happen, do you hippies expect do live in a home for free? who else is going to kick you out when you havent paid your bills?
@GixxR606 actually lots of people paid their bills and still got kicked out. BANKS LIED. They went to court with documents saying no bills were paid WITH more documents showing bills were paid. They lied. They went to court with loan documents that never existed before that very day. That's right, they forged signatures for properties which have NO LOAN TO ANYONE. That's a fact. Bank of America did that more than 10 THOUSAND times.
Here is what I don't get. Why harass the cops when they are doing their job properly? I understand when cops think they are above the law or disrespectful but this doesn't fall under that. Dispatch and higher ups tell them where to go. This is part of their job description. They can't pick and choose which calls to take. Luckily they weren't dicks and fucked you guys up. Now that would be a valid reason to complain.

serve the lender with a commercial presentment, demand forensic accounting evidence of any monies loaned where assay loss was incurred by the institution, demand the original contract containing all elements of a valid lawful contract including wet signatures, giving 21 days to rebut line by line, and if they fall silent it's default via tacit aquiescence by latches and estopple that the homeowner's counter claim is true for failing to prove a claim of liability. It remains on the pvt. side WIN!

@DavidLister6000 sounds like you have some experience with the jail scene as often as you mention it. Still embracing those soap dropping days with you and Eduardo "Meat" Sanchez and his giving you his dirty sanchez, stop hiding in the closet ,it gets better.
The fact is, noone owns any property. Its all owned by the state. Dont pay any taxes and see what happens... Its not just banks. We are all just slaves on the big plantations, that includes all cops. Most people willingly enter into contracts with banks and corporations without the education to read the actual contract. If you did. You would rent like I do
For the last time Pete, Ademo, you do not pay their salaries. You are unemployed and are either drawing sometype of disability or SSI as income. Without an income (W-2/10-99) and without paying a millage or property tax for police services, you do not pay them...In other words, when sometime in the future, someone kicks your teeth in, its me, the taxpayer, that pays the police and the court system to prosecute the suspect, at no cost to you...
@DavidLister6000 ooooh I like that thought. its us the tax payers kicking them in the teeth. omg that just made my day. thanks dude you just put a smile on my face.
@pocomedy I dont like it either but that is the system we live in. But if this is the system that we live in and we dont like it - maybe we should fight that system. putting alot of attention on people performing a job they know, as just as it is, is negative has been proven throughout history to get people to stop participating in corrupt policy.
You have to pay the mortgage and property taxes. That you can't get away with. The problem is with these finanical institutions is that it is basically their way or the highway in other words. They are taking every advantage of their customers espeically the customers that can stay pay. People are at the mercy of the finanical institutions. Instead of these finanical institutions taking a little less to help people, the cry about losing a penny.
A person who takes a mortgage signs a contract and agrees to submit him or herself to a court of competent jurisdiction in the event of a legal contest.
Are you saying that the home owner didn't have a right to enter into a legally binding contracting whereby he agreed to have a court determine the issue in the event he was unable to meet the conditions of said contract? To say this is unjustified is to say contracts aren't enforceable, or that one may not voluntarily enter into one.
@integralmath actually, I am not sure that is the issue. mortgage companies are notorious for not being able to show that they are in fact the owner of any particular property. i don't know what's going on with the property in the video, but i guess with out more information this cannot be ruled out.
@roaringwaterbay this literally makes no sense to me. The mortgage loans the money; in the event of forfeiture of the loan, the property in question is transferred to the mortgage company that might be sell it to get a return on their investment. If someone has a mortgage, they have agreed to this state of affairs as it's a condition in all contracts on mortgages. A mortgage company would be foolish not to make that a condition of the loan.
@integralmath i am not arguing with you about what terms mortgage contracts probably, in general, usually contain. mortgages are, however, frequently sold and re-sold. if a lender wants to foreclose, the smart property buyer will make the lender prove that they in fact own the mortgage; this means having the requisite documents. if the lender does not, well, that's a new game.
@roaringwaterbay okay. So, your point is essentially, then, that mortgage companies on the whole keep shitty records of their transactions, and transfers of property, debt or acquisitions such that when court comes around they lack the original contract and whatever paperwork attaches as the loan has been sold and resold. Well, clearly not.
But sure, if they go into court without any paperwork then they should expect to lose that case.
@integralmath well, i cannot tell you how widespread the problem of missing documents is with respect to mortgage companies, however, it clearly exists. some homeowners have stopped foreclosures because the courts have agreed with them that if the lender cannot demonstrate the actually own the loan, they shouldn't be allowed to foreclose. but, in line with what i think you have been saying, if they keep adequate records the borrower will probably get the boot.
@roaringwaterbay well, to the extent that it is a problem, the mortgage companies should lose in court. There's no honor system in presenting evidence; you either have it or not. If you can't demonstrate the claim as being true, the claim must fail - I have no problem with that whatever. Nor do I have a problem with the police enforcing a contract someone freely entered to when a court, to which the contracting parties have agreed to let settle any conflict, decides against one party.
@roaringwaterbay the burden lies with the claimant,so if the lender says you owe money they must prove up the claim by producing the forensic accounting along with original contract containg all elements of a lawful contract including wet signatures, see they never will produce it as it's been on sold as derrivitave security which is fraud and whoever holds the original contract is the liable fraudster. I'd ask for default judgement after 21 days and no response, the claimant loses period.
you need to tell them people it is ok for them to move back in. foreclosed homes on avg are empty from one year up to eight. i think the national average is like 18 months. and thats only on paper not really people moving! and if they do move take everything but the outside walls and celing.
You guys are sick. I know these police officers hate doing this, for a fact. They are sick to themselves for doing this part of their jobs.
