I understand your concerns about our rights being infringed upon. But, in order to even exercise our rights, we have to make sure our basic needs are being met - in other words, victims of bullying who have killed themselves have no rights to exercise. Also, the Constitution states its purpose is to "establish Justice, insure domestic Tranquility ... promote the general Welfare." These steps help promote these for kids who may feel completely silenced/as if their rights were taken away.

Statutory rape
Criminal Harassment
Assault (involving a second victim)
Stalking
All of these were already crimes. The creation of a bullying statute allows for offenders in these situations to be charged with lesser crimes earlier. They need to be careful, as I said, not to take it so far to cover things like simple rude/insulting speach of course
That being said, anyone who has been the victim of criminal bullying in school or lost a friend to depression and suicide because of bullying can tell you that this is quite necessary.

Now, will the school adminstrators execute their parts in this properly, or will this turn into another situation of zero-tolerance taken to insane extremes? Now, this should clearly not criminalize behavior that is simply mean, or rude, or insulting. It should only serve to provide a way to prosecute already criminalized behavior by those who are old enough to know the wrongness of their actions but perhaps be too young to be comfortably tried as adults.
It allows children to be charged with a less serious crime than the felony they might otherwise have to be guilty of. This allows prosecution of what was already considered criminal but merely not enforced since the defendants would be children and many DAs are loathe to charge a child with a felony. This new statute encourages enforcement by creating a law that addresses the gap between those too young to understand the wrongness of their actions and those who should be charged as adults.
Most of what the kids in this did were already crimes- and have been crimes for quite some time. Harassment, assault, statutory rape, stalking, etc. have been illegal under some statute or another for a while.
There is a practcal purposes of putting some of these acts under a "bullying" statute, beyond just scoring political points.

They can and will learn to either cope or rise above, just like centuries of tormented people have. On the other hand you have someone of authority or not telling the kids "no this isn't right! They are being charged with crimes such as:
Statutory rape
Criminal Harassment
Assault (involving a second victim)
Stalking
All of these were already crimes. The creation of a bullying statute allows for offenders in these situations to be charged with lesser crimes earlier. They need to be careful, as I said, not to take it so far to cover things like simple rude/insulting speach of course

For the most part, that is what this law does. Now, will the school adminstrators execute their parts in this properly, or will this turn into another situation of zero-tolerance taken to insane extremes? That remains to be seen, but anyone who has been suspended for bringing a screwdriver to school to use in their "science olympiad" project can tell you - administrators should be thoughtful and careful in how they execute their duties in this matter.

It should only serve to provide a way to prosecute already criminalized behavior by those who are old enough to know the wrongness of their actions but perhaps be too young to be comfortably tried as adults.

It allows children to be charged with a less serious crime than the felony they might otherwise have to be guilty of. This allows prosecution of what was already considered criminal but merely not enforced since the defendants would be children and many DAs are loathe to charge a child with a felony. This new statute encourages enforcement by creating a law that addresses the gap between those too young to understand the wrongness of their actions and those who should be charged as adults.

Most of what the kids in this did were already crimes- and have been crimes for quite some time. Harassment, assault, statutory rape, stalking, etc. have been illegal under some statute or another for a while.
There is a practcal purposes of putting some of these acts under a "bullying" statute, beyond just scoring political points.
