Justice Hugo Black is what we would consider an activist Judge. He also represents what some would now call "THE LIVING BREATHING CONSTITUTION." By the way, if you accept the ideal of "THE LIVING BREATHING CONSTITUTION",then that means our Constitution dosen't really exist since activist judges can interpet the constitution to fit their own personal beliefs.

Article V of the constitution provides a procedure for amending it. The Judiciary has no part in that process. Pres. Wilson in 1912 believed the const. must evolve. Today its morphed into the Living, Breathing... The courts were meant to be the least powerful of the three branches. Their not because Congress has failed to do it's job.

Judical review is not a concept that is in the Constitution. This case represented the checks and balances of the 3 branches which was appropriate. It's one thing to say what the rule of law is and another for a judiciary to say what he or she thinks the rule of law is. Just for the record the 1st Admentment was written to prevent the establishment of a NATIONAL CHURCH. The wall of sepration between church & state comes from a letter by Jefferson sent to a baptist community to explain why he didn't call for a national day of feasting & Thanksgiving. In the 1947 Everson V Board of Education, Justice Hugo Black used the metaphor "wall of ..." to base his decision in the case. Black was a member of the KKK and was resentful of the growing influence of catholicism.

Living in Utah, we are always quite ashamed by Sen. Buttars. On 2008-02-07, Buttars referred to a bill he did not support as "a black baby...a dark ugly thing." The NAACP called for his resignation. It didn't happen. We were all hoping he would get defeated for reelection. It didn't happen. Those in Senate District 10 who voted for him on the 4th should all be ashamed of themselves for reelecting for reelecting a bigoted idiot.

The etymology of the word holiday is pretty interesting. Holiday means holy day. So, I don't know what the secularists are going to do when they figure this out - since they are so adament on keeping everything holy out of matters of state - unless of course the word holy is being misused.

However, the term "Happy Holidays" is more inclusive, as it covers several religious holidays plus New Years - retailers can appeal to more people.

Don't forget that the word holiday is derived from Middle English - "holy day" to be literal.

The word holy describes the character of God - specifically, the one true God - Yahweh. The word holy - when properly used - is only as inclusive as Yahweh is. That is, all who come to Christ by faith will be included in the Kingdom of God. All who reject Christ will not be included in the Kingdom of God.

A "secular holiday" is an oxymoron. When the Supreme Court said that Christmas is a secular holiday, they said that Christmas is a secular holy day. There is nothing secular about that which is holy.
