  • I have the same problem. I'm on blip.tv, most of the videos with the adverts have movie scenes, music, etc, but I got a reply from blip.tv it's against their rules. But then how almost everybody making profit with those music/video clips? I just wanted to use old video game music, they said I can't. But then how all the videogame/movie/music reviewers using them? I don't get it. Can someone explain this to me?

  • dude, I'm a partner, as long as you got permission from the original owners of any other copyrighted content (and provide proof) you'll be ok. if you want to become a partner you have to deal with some of these things. it's worth it.

  • Chris Bores steals countless material from James Rolfe, uses movie and music clips, and made hundreds of bogus copyright claims from his fake Y2B company that's a rip off of cinemassacre. He should be suspended AND fined, but jewtube won't do that because they make money off of his lard ass and he makes money off of them and his DVD sales.

  • Youtube only deletes copyrighted stuff when the original creator sees it and gets mad. Youtube doesn't do it. the companies do.

  • Want to know what i have a problem with? If people want to become YouTube partners, but they don't have permission to use the copyright, the big-shot companies that you want to get permission from aren't going to cut time out of their life to comment back on some random person they don't know. So there's no way to GET that permission that you need. Almost ALL Youtube Partners use copyrighted stuff. Supermac18 uses 3OH!3, smosh took audio from There Will Be Blood, Fred uses Kev Blaze stuff, etc..

  • It doesn't work like that man. You contact the publishing company that represents the piece of work that you are trying to obtain a license for. You then pay a fee for the use of that license the same way that tv shows, radio, commercials etc... does. It's not that hard. You just need to do the research and put up the money like everyone else.

    As an artist, I get paid for the things I create and I resent when people profit from my work w/out compensation or proper credit given. stay fair.

  • yeah like with songs, i think you should have permission to use them, but not make a profit if you purchase the song.One of my friends videos got taken off because of the song, and he bought the CD at WalMart, so i think you should have permission. And another thing, i uploaded a video that 3 or 4 other people had on youtube, and i got copyrighted by the company that make the show i put on, and i really think its wrong that YouTube uses a double standard for normal youtubers and partners.

    302 Subs

    15,851 Channel Views

    180,451 Total Video Views

    But a few of my videos were copyright claimed by WMG, but I disputed those claims and I could keep the videos. Would I be able to be a partner?

    And If i was a partner, would those videos be deleted, or would I get suspended?

  • I hate all this crazy copyright stuff. I mean you can watch whole music videos of whatever song you want on youtube and those people don't get in trouble. But I make an animation, which is my own, and use 30 seconds of a song in it, and my videos get muted and deleted. It doesn't seem to be fair how it is now. I see what you are talking about how a popular partner shouldn't be allowed to do what us non-partners get punished for. As it is right now, the enforcement of copyrights isn't fair.

These laws can't be enforced equitably, they limit creativity too much and the public isn't going to stand for it for very much longer.     I'm personally thinking of becoming a partner as well (but guess who has no fan base =o,) but yeah, the rules and stuff do blow because it's pretty clear they aren't followed. It actually seems like partners are privileged, while non-partners are the only ones punished for copyright.

  • I decided as a partner to only monotize videos that had no copyrighted content.

    Whether or not other people followed that policy shouldn't have been a determining factor in whether or not I joined it. I can still have integrity where others don't.

    Becoming a partner has ultimately meant about 1000 more subscribers than I had, and a pretty banner for my page and videos.

    I haven't made diddly squat monetarily because only about 5 of my videos are approved for google's adsense program.

    I've had some videos taken down because I've used say for example, Fur Elise (no joke), and the song-sensor whatever technology that YouTube uses has muted the video ("Elmo Suicides") due to this copyright infringement. Do you think they've denied my partnership application because of this violation, or simply because I only have 315 subscribers?

    I'm really lost here, so any thoughts would be appreciated. Thanks man!

  • Wow! So true, i was wondering this myself. I'm hoping to someday become a partner(not too near in the future)and i was worried about rejection based on the copyright policy. I'd have to say i disagree with the policy to some extent. I mean i don't really understand why we should be banned from using copyrighted audio in your videos, unless you have a band or something, it's not really feasible for the average partner to create their own audio and have it be just as entertaining.

  • When you take a video game or movie footage and use it to create a review/parody, the resulting video is your copyrighted creation and thus you own the copyright and are allowed to upload it via YouTube partner program.

  • When people like David Letterman or Jonathan Ross (BBC TV film reviewer dude) include film clips, either because they're interviewing one of the stars, or doing a review, they generally put a copyright thing over the clip, or mention the distributors who let them have the clips in the end credits.

    But the wording of that policy is a bit of a fudge to me, and I don't know how well it would stand up in laws, especially outside the US.

  • The same thing just happened to me, with regards to a song I used, apparently, but it wasn't a whole song, it was a clip of a song! Just in the title and the credits, like I've seen a million people do.

  • expressed written consent would fall under the distribution rights in the clause, as for fair use I'm not sure but i need to look in to it for my own reasons.

    Fair use is very clear at it's core and then unclear on it's fringe.

    I need to refresh my self on copyright laws before i make my run a partnership over the summer. (obviously on a new account, unless I can have a talk with Tite Kubo)

  • Partners can upload videos, and not monatize there video, and they can get away with using copyright material. But if they want to monatize it, and be able to make money off of it, then they cant use any copyrighted stuff.

    At least that's what I've heard. If there are no ads next to the video, then they aren't making money off of it.

    I think you should apply. Don't beat yourself up over this as you may not even get accepted. I mean if ScrewAttackEurope was rejected they clearly don't care about quality.

    View count is probably their only criteria. Irrategamer got featured, lots of views and thus became a partner. YT don't care about copyright. They ban people on tenuous copyright claims and turn a blind eye to blatant stealing.

  • But... if say, I record bits and pieces of video games, and add commentary, that wouldn't be copyrighted to me - because the game, music, sounds and whatnot are owned by the company (or companies) who made and published the game.

  • Actually, having videogame music, gameplay footage, and a commentary over it to make is as a game review does not violate any copyright laws, because generally speaking, the videogame companies dont care about whether their copyrighted work is used legally or illegally.

    The only time they do care is if a person uses the company name(Ex. Nintendo, Sega, Sony, etc.) or uses company trademarks(Ex. Sonic, Mario, Samus, Pokemon, etc.) and makes a profit off of it without their permission.

    It shows, from your simple Transformers PSAs to your rants. They display not only your passion but your talent. You deserve to be paid. So, go for it. The rest of the video with the copyright issue, to me, it's always going to remain a grey area. Overall, do what you want, that's the main thing.

I've given it some thought, and I don't think I'm going to seek partnership until YouTube features one of my videos or something happens where I get a much bigger influx of subscribers. Afterall, YouTube will be the ones making the most money off my videos, and they'll only be cutting me a fraction of it.

  • Anything from the 30s and before should be fair use. However, the question really is: is the record company that represents that artist going to threaten to sue youtube for your use of their music?

    Generally, the answer is "no", so unless the video gets flagged, YT doesn't care.

    Your videos are fun, and you have a subtle sense of humor, but your last two vids are not fun: you become serious. U don't seem to enjoy the simple fact to SHARE your opinions about life or videogames or else anymore. Becoming a partner means loosing your priceless generosity, ie the 'cheap and sympathetic' sides of your vids.

  • I think you showed a major flaw in the 'youtube partner program' right now. Copyrighted content, even in fair-use, or if you have permission, is not allowed according to the youtube partner program. 'NO EXCEPTIONS' makes a pretty clear statement to that. Unfortunately it seems they have a way of 'slipping violations through their fingers' when it comes to popular video creators. I would personally think twice before I signed on to do something I can't follow, even if you do deserve it.Good luck!

  • What's the point in everybody being eligible to become a partner? Almost all youtubers (I know, I don't want to generalize here) that became partners started to whore/sell themselves somehow or lose quality on their videos as they have to deliver no matter how bad or unfinished it is. My advice (at least for now): stay away from the partnership.

    And violating copyright infringements is never any good, if it's done in fair use it's fine but not if you cash in on it.

  • hey, just wanted to say you deserve to be youtube partner. your videos bring quality and entertainment and innovative. I just think if your not able to use music or any copyright stuff your videos may be sort of lack..unless your like other youtubers who vlog then its okay aslong as its enjoyable to watch.

    on the left area of the page are 5 images, one of those images is a picture of the happy tree friends... unless the actual copyright owner of the happy tree friends is on youtube, someone is definitely using some fair use law :p

    as for your final question, it seems that you've made a comeback to more active video making, if you can keep that activity up, you should definitely apply.

  • the "no exceptions" thing is indeed pretty stupid.

    fair use and permissions shouldn't be a problem, Youtube should clear that up.

  • I know about that guy who stole your video. He also stole videos from other people like UrinatingTree and PlayitBogart. He never gave them credit and he tagged an annoying ad for his spam site at the end of them. He deserves to be flagged and banned, if possible.
