GUARDIAN AD LITEM

I am a Guardian Ad Litem at the New York City Civil Court. First, there is NOT enough information in this video to determine why a judge granted an Article 81 Guardianship for this man. Second, I did NOT hear that he was medically re-evaluated. Third, as A Guardian Ad Litem, I provide a good service for people who are unable to defend themselves. I have defended a multitude of people from opposing attorneys who wanted to have them evicted. Thus, guardianship is not all bad.

He should find a lawyer some one who is willing to take his case to appeal the decision of the court also he should contact someone who is responsible for the apartment he lives in like his land lords boss write a letter to them explaining what is wrong in his apartment and what needs to be fixed and tell them that the land lord refuses to do anything about it and if this continues he wont be paying any of his rent ! @wildstarfall my family also lives in an apartment and when we find problems with any part of the apartment needs repairs we put it in writing and give it to the landlord and if nothing is done we don't pay rent it actually states by the company that if we put it in writing the repairs that need to be done and give it to the land lord and she doesn't fix it we are allowed to withhold money until the repairs are done

MY neighbor had a guardian. The guardian paid herself every time she visited and charged $1.00 per mile to drive from her house to visit my neighbor and 18.00 dollars an hour - again from her house to see him every day. I know this because she told me so and bragged about it! This man gets social security but ownes his house... the way I see it the guardian is sucking this guy dry. The judge needs to know that using guardian needs to be a last choice not a first choice.

Amen to the NASGA. As a family member, I had to suffer on multiple accounts by the abuse of an incompetent lawyer, then a second lawyer who referred me to a so called "social worker" who in turn wasn't able to get secure funding for my loved one in the nursing home. Then the guardian appointed only cared about money and I doubt did any work regarding securing government funding for my loved one. It's a nightmare.

According to the law of NY, appointment of a guardian for a person should only be done as a last resort. Most Judges just appoint a guardian, period. It seems to me that many times, the whole issue is about money.l Once appointed, it is almost impossible to get rid of the guardian, unless you run out of money.

Questionable guardianship? First of all, how Murray became conserved is not as relevant today as how he can improve his life with a replacement. Health needs must be met, dental and hearing, which equals understanding.

If the man is capable of working, how can it be claimed that he is incapacitated? He's DEAF, judge - not dumb! Give him his hearing aids and terminate the guardianship!

Okay, nasga that is fine, but here's the problem I am having. Why did he need the "protection" of a guardian in the first place? If he was having issues with his landlord why didn't he just file and HPD action? Something isn't right here. One doesn't get a guardian because you have a problem with your landlord. No. I guess my education just lends to the usage of certain words and phrases. I am just a person with intimate knowledge of guardianship, the legal system and the like. I've seen all sides of the issue, abuse, protection and all the rest. I can appreciate watchdogs. I know about MHLS and other advocates. I just see many holes in this case. Guardianship agencies are accountable to the courts aren't they? you can't just paint a broad brush here. they have to file accountings of how they handle money. What was the condition of his home at the time of guardianship? What were his debts if any? One person indicates he would have been homeless if not for guardianship. I would guess that you might work for SelfHelp...Why dont you identify that fact? Murray's situation has changed since 2002 when he first got a guardian. Now be honest, if you made $ 50,000 a year PLUS overtime would you turn it over to a guardian if the guardian gave you an allowance of $325 "walking around cash" for you and your spouse, Oh wait, there would be one more condition, you would have to give up ALL OF YOUR RIGHTS. Does this sound like a good deal to you???

I don't have to work for a guardianship agency, I just have to know guardianship which I do. My question to you is this, what precipitated this man's guardianship. His guardian is a company called Selfhelp Community Services in NY. I met with Murray in person and he is in need of a hearing aid and dental work. A family member wants to be his guardian instead of Self help. You may not know that a guardianship takes away all of his rights. Would you word full time OVERTIME like Murray does? I read Murray's entire file at the courthouse, spoke to his family, met him in person, saw the accounting from Self Help, and tried to contact them but they did not return my calls. All guardians profit from the wards funds sir. That is a fact. Some states set limits but most leave it to be discretionary. As a social worker, you make referrals but probably have little contact after the fact when the estates are drained and the family is kept away.
