That is optional of course if it does get really cold even for the animals then of course shelter or provide a blanket but if it's 30 or 40 degrees they have no problem with that type of weather even colder sometimes.

When it's an uninvited person on your personal property, you have a right to record them for the purposes of defending yourself in court. The actual law in New Hampshire specifically allows video recording and specifically denies audio recording of people without their consent. Thus, this recording is legal (though an argument could be made that the mic needed to be turned off).

If the property owner did not give them permission, the cop should have just gone and executed a search warrant. Then any attempt by the two to deny him entry at that point could have resulted in an arrest and they wouldn't have wasted so much time. Animals do have rights folks, like it or not. This SPCA investigator needs a warrant to search the property. The cop being there makes no difference because he has no warrant either. The officer says "ok" when he's told he is being recorded which any judge would consider consent. The cop is wrong as there is no law that states what he states so he is an idiot and has no right to arrest a citizen on the citizen's private property, there is no expectation of privacy and the officer is on public property.

Are the horses part of the owners possessions? Yes, is not the investigator wanting to search for the shelter since he cannot see it? Although i wouldn't have arrested him, New Hampshire is a two party consent state which means that if more than one person is under audio and or video surveilance than both parties must consent to the surveilance so technically it is an offense punishable by law.

Shelter for the horses, what a load of horse shyt. Punt attended first off horses,cows,dogs and pretty much all wildlife even domestic don't need shelter look how they survive in the wild. That is optional of course if it does get really cold even for the animals then of course shelter or provide a blanket but if it's 30 or 40 degrees they have no problem with that type of weather even colder sometimes.

This is really disappointing... I always thought Candia cops were pretty cool... at least in regards to the limited interactions I've had with them. (Raymond cops are a different story...) You would think a "law enforcement" officer would have a better understanding of the law. Hopefully, with the rulings being set forth in courts around the nation upholding the rights of private citizens to film public officials as they perform their duties we'll see less and less of this. To all of you who say that it's illegal to record someone who doesn't want to... When it's an uninvited person on your personal property, you have a right to record them for the purposes of defending yourself in court. The actual law in New Hampshire specifically allows video recording and specifically denies audio recording of people without their consent. Thus, this recording is legal (though an argument could be made that the mic needed to be turned off).

I thought search warrants were for GOVERNMENT agents, not private citizens. Private citizens cannot enter private property (ordinarily) because of trespassing laws.

If the property owner did not give them permission, the cop should have just gone and executed a search warrant. Then any attempt by the two to deny him entry at that point could have resulted in an arrest and they wouldn't have wasted so much time. Animals do have rights folks, like it or not. Do something constructive yourselves to decrease taxes, deficits, etc. and stop mouthing off.

This SPCA investigator needs a warrant to search the property. The cop being there makes no difference because he has no warrant either. The officer says "ok" when he's told he is being recorded which any judge would consider consent. The cop is wrong as there is no law that states what he states so he is an idiot and has no right to arrest a citizen on the citizen's private property, there is no expectation of privacy and the officer is on public property.

@DavidForthoffer If any investigator goes to a property to execute a search, they either need consent by the owner or they need a warrant. If they have neither they are in violation of the 4th Ammendment and any "fruits of the search" will be inadmissable.

@bigoutlaw1: You sound like yet another person who thinks the 4th Amendment protects all private property. But it does not. It only protects "persons, houses, papers, and effects". Since she did not search any of those, she did not need a warrant.
You may also be thinking of the Exclusionary Rule, where evidence found in violation of the 4th Amendment is excluded from trial. However, that Rule only applies to CRIMINAL cases. In CIVIL cases, like this, such evidence is admissable.

@DavidForthoffer did u listen to the investigator who stated that he could not see the shelter that the woman was referring to nor did he ask what kind of condition the horses were in which is what investigators ask to develop probable cause to search. He cant see the shelter and the owner of the property is not there so he cant go on the property without consent unless he has pc or a warrant to search.

@DavidForthoffer Every subject has a right to be secure from all unreasonable searches, and seizures of his person, his houses, his papers, and all his possessions. Are the horses part of the owners possessions? Yes, is not the investigator wanting to search for the shelter since he cannot see it? I worked in law enforcement and talked to uc officers everyday, this is how it goes.

@bigoutlaw1: "Effects" in the Fourth Amendment does NOT mean "all his possessions". It means "movable personal property". Although horses are protected "effects", the stable or shelters are not. The investigator and the property manager are dancing around an issue of trespassing, not a Fourth Amendment issue. You working in law enforcement gives you credibility in certain areas, but not constitutional law.

Although i wouldn't have arrested him, New Hampshire is a two party consent state which means that if more than one person is under audio and or video surveilance than both parties must consent to the surveilance so technically it is an offense punishable by law.
