THANK YOU SO MUCH FOR THIS! My husband has gone through HELL for the last 3 years with his ex-wife with all of the incidents you have described. He can't afford a lawyer and the courts are so biased, we would be homeless trying to pay an attorney. God Bless you for this!!
The State and Federal Government own you inless you claim your UCC-1 Strawman - you are presumed a 'debtor' in the Crown-D.C.-Vatican system unless you are aware and declare.
@somotastic21 Women are not always right, but i do believe its been made a point already that the justice system is NOT fair. Women should not take advantage of this, but women, being smaller and weaker than men, do deserve to have more protection.
@leetledanigirl They deserve special protection. My issue is with the justice system which will seemingly always take the woman's side. Men and women both have to worry about different things from each other. Women have to worry about getting physically attacked by men and men have to worry about getting accused of something by women. Obviously the physical thing is more life threatening, but accusations can also ruin a person's life
To be honest It scared me so much because I didn`t think this system is so primitive to back up false reportings.I know eventually I`m gonna have to sell the house and move back to Europe.I have never experienced this side of this country that millions of hard working americans have to face every day,and even families break up because of this.It is awful what is going on.But god bless everyone and take care of yourselfes, and choose your partner wisely.
And you guys have to be very very careful about restraining order, even if you`re the one who wants to put protective order against someone, because even if you don`t go no near by that person or you didn`t try to keep in touch with that person, but if that person calls the police and says you broke the protective order...guess what? The police will arrest you and put you in jail, there are no investigations and nothing. It is basically a HE SAID SHE SAID THING.It`s about who calls the police first.
I`m thinking about moving from the united states because it is actually very similar to systems like socialism or fascism. You can have a property but if it comes to ``fake reportings`` you can`t do anything. You will not have the right to go back to your own house. And let`s face it a piece of paper never protected anybody in this world. You can be the most good hearted and innocent person in the U.S.A. antil somebody press charges that are often fake. This is actually a huge business for the court.
I have a horrible experience about protective order. My wife reported me after her ``beating me up`` and I just grbbed her wrist to defend myself....but it still didn`t matter the police pulled me out of my own house and MY OWN PROPERTY,and put me to jail.I can`t legally defend myself in this country, domestic violence is justified for women but not for men. There is no investigation at all,the police will put you in jail because she said so.I know it sounds impossible but it is true.
i won my restraining order whoohooo hears how,,,,,when the judge asks how long u dated and she says 2 years 3 years etc. just turn around and say nooooo we never dated she was just a booty call and now im moving on to the next. judges love to hear that your not obbsessed and moving on and if you never dated then a restraining order doesnt qualify .me and my ex then got back together and i made her go back to court and say she lied so its removed off the record and now she is on probation
A lot of people will make up all sorts of stories to try and make someone look like theyr'e doing something that they are not doing and try to threaten you with it the police usually can't be bothered long enough to actually follow up on any of it unless it's a true hate crime against a person some people confuse love with hate and foolishly act upon their own misjudgement some cry wolf as an act of revenge
false allegations of domestic abuse are common. No physical evidence is required. After being dragged thorough the courts and cleared or charges dropped the individual who filed the false police report is never charged.
Actually I'm in the same situation as you but I am the mother and the WOMAN. My ex husband did what your exwife did so no it's not just woman in general. I have been going back and forth with him and in the cout and they protect him and I am the victim! He even showed up to restraining court today intoxicated and still got away with it! He drives durnk with them, leaves can in the car and still get's away with it!
IN my opinion, since restraing order judges are so completely accustomed to disregarding your rights, your only hope is to go WITH A LAWYER, to a court where judges are generally respectful of rights, and the best way to TRY, you may not suceed, to get there is to preemptorily challenge the judge. That way, they will have to refer the case ot some other judge who is not in the habit of violating your rights. And GET A LAYWER, but make sure the lawyer will challenge the judge.
I live in Northern California, Oakland, one of the places the rest of the counttry can justly blame for starting this horrible phenomena. I believe, in this area anyway, the most important single thing to do to fight the order is to challenge the judge who presides over that court. You can try to find a reaosn for the judge to be recused, but likely, hyou have to issue a preemptory challenge. The reason is, restraining order court's routinly disregard the rights of defendants, that is the norm.
my ex put a restraining order against me and still called me harassing me. i called the police and they told me she could call me but i couldnt call her lol
This is good info. My brother is going through a fake restraining order. The people that are really abused cannot get the help they need because of these idiots crying wolf as an act of revenge.
I feel your pain my man, my girl got one on me and she kept coming back to me saying, oh I forgive you and then one day I say, "Oh I feel like killing some people."
There was no epic fight, no threatening her and she blocks me and next thing I know coming in the mail is a restraining order...
I think even if there is "evidence," it should be checked thoroughly, and the "victim" should be checked for "fear of harm" or something in the court, too. I'm being filed against by my ex-boyfriend because I kept sending him emails, but there's nothing incriminating or harmful in them. This makes me hate penis/male ego.
@bitterxreilly Depending on the law in your State, sending unwanted emails can be considered "harassment." An email could be considered at the same level as unwanted continued telephone calls and therefore considered harassment even if there are no threats. Threatening email / telephone calls could rise to a higher crime. Restraining Orders usually cover "harassment." Documentation of an offending party's emails as well as telephone calls can easily be obtained through search warrants.
@bigibrd Lame blames all around. I know what "harassment" can be considered as. I also know that ridiculous is you commenting something like that on a video that is AGAINST ridiculous restraining orders, not trying to help anyone understand them. If it's f-cked up it's f-cked up. Do you understand that
Did you significant other or child get one on you, or are you just annoying?
@bitterxreilly Regardless of what these videos stand for... I am for fairly enforcing the law. It is surprising how those who have a restraining order against them continue to make excuses, violate the order and the law. If you want to win the battle...you need to follow the law and do the right thing. Quit giving your ex ammunition against you. Your children will eventually see the truth and the parent who is in the wrong will lose in the end. What exactly do you don't understand?
Who said anything about violating a restraining order? My ex manipulated everything about our situation on the papers to get the judge's approval.
I'm not playing this game. I don't even know you. Nobody asked for your advice. There is no right or wrong involved with laws that are based purely on feeling and ego, which restraining orders are. Relationships do not revolve completely around "right" or "wrong. Feelings and ego play a larger part than morals
@bitterxreilly I guess I did infer that you had children involved however the majority of people do in restraining order situations. The remarks referring to children were meant as a general statement to those who may be reading the post. If the judge approved the order based on the information he was given, then one should believe that he made that decision in good faith.
@bitterxreilly The Judge, whether female or male, can only make a decision based on the presented information by both parties. Restraining orders are common in divorces and relationships that do not end well. You say There is no right or wrong involved with laws that are based purely on feeling and ego, which restraining orders are. I disagree, as there has to be facts involved in the case, which violate the law.
@bitterxreilly Examples: Harassment, prior violent behavior, prior threats, prior following, prior stalking, prior molestation, destruction of personal property, disturbing the peace, keeping the person under surveillance, or block their movements. I am not saying you did any of these things however there had to be some kind of circumstances for the Judge to rule in your exs favor.
@bitterxreilly You say I am not trying to help anyone understand a restraining order, so that is why I asked you what you did not understand. I have never had a restraining order against me and I could be considered an expert on restraining orders. I have spent the last 22 years dealing with people who do have restraining orders against them and helping those who have needed one. Like I said in a past posting, getting a lawyer to defend you in a restraining order hearing is the best strategy.
Facts and feelings go hand in hand. Someone gets scared because of outside influence or interior motive, good or bad depending on who has the "best" argument, and interprets a factual event differently than the other party. Done and done. Your case isn't as good as your evidence, it's as good as your argument. if you have shit evidence or even no physical evidence at all to back up your argument, you can still win a case with mad persuasive skills.
Restraining Order issues are serious and court hearing decisions could change your situation drastically if you do not seek proper counsel. Always provide the truth in court as lies or manipulation of the truth will definitely be held against you when found otherwise.
I would highly suggest that if you do have family court issues which involve a restraining order, whether it is restraining you from your wife, significant other and or children, you seek consultation with an attorney as soon as possible. As RonLasors911 admits, each State has different laws and therefore you should seek an Attorney who knows the laws in your State. I would not volunteer my name and email address to anyone I do not know.
Protection orders should need the proof evidence. not the proponderance. The order can (almost always does) restrict your firearms rights. Not to mention if you had childern. you better have a good paying job.
I finished reading Restraining Order 911 this morning. I wish I had read it right after I had been served with an order of protection instead of a couple months later. While I found the information useful, it would have been a lot more helpful before my "hearing", where I wasn't allowed to submit any evidence or say anything in my defense. I should have another chance when the case is transferred to our home state instead of the state where my wife went to file for the order. Thank you.
is it possible to ask you a few questions?
