If the bailiff was a court bailiff, you may be on a sticky wicket. They are officers of the court and it is an offence to obstruct them. If he/she was a certificated bailiff, the police should not have assisted them in any way.

The only person who can put a Police officer on his oath is a Magistrate, and this is only ever done once, at the beginning of an Officer's career. The police are there to prevent a breach of the peace in this particular instance. If that means using force to allow a bailiff to do his job then so be it. That's actually a power given under common law, so you haven't really got a leg to stand on there.

Police don't fine anyone, they issue a ticket which gives the option of not going to Court, admitting guilt and paying the a smaller fine than you would get if you were found guilty having chosen to go to Court. The policy officer was not acting as a peace officer because he did not agree to it,he simply ignored you and kept going as a policy enforcement occifer.You must ask them if they are on their oath and really get them to understand that fact first before proceeding on with the matter,if that does'nt work then ask for a supervisor pull him aside and tell him what you need from him,you should never consent to a pushy policy officer representing the other guy.Cheers

Michael, in regards to an order from the court, no. its an admin process from the traffic office, big difference. Also its about not contracting with any of their shit. we don't want it. Example, we pay tax for car parks to be built, human labour & sweat makes it happen, we are then paid in credit & have to pay to use them, plus a penalty charge. I don't think so!
