Observe him carefully, the way he responds to him and the way he gets angry (at some instants). The judge if he's a sensible person or not. If he is lying, Allah will treat him in the same manner but we can't reject his testimony if he's swearing on Quran because by doing so, we're indirectly showing our disbelief in the Quran and not the person.

@Nazi302 Just watch the videos (it is present on youtube) of the remaining part of Javed Ch's show "Kal Tak" in which zaid is arguing with someone from India. Observe him carefully, the way he responds to him and the way he gets angry (at some instants). The judge if he's a sensible person or not. He's a person who cannot control his senses when it is utmost needed. He's transferring that into us by means of exaggeration.

On one hand, he's accepting that he's not qualified to do so, while on the other hand he's doing something which he's not qualified to. I really don't get the logic behind this act.

The term Mufti or the office of Fatwa was created during the last period of Ummayyadi mallukiyat, fully stablished under Sultans, there is no etymology on fatwah or a cleric mufti in islamic Law, shariah or even history ( khulafa ar Rashiden ) fatwa office flourished under Turkish empire,
salient features were:
Fatwa can only be ordered by Khalifah, Amir or Sultan
Fatwa is invalid on principles if islam, haram & halal, Quranic injunctions, etc
Fatwa is only valid on 3 matters
