  • I think the officer approached the situation incorrectly by demanding the camera. What the officer should have said was something along the lines of, " hey guys do you mind not filming us, thanks". I think most rationale people would adhere to this type of approach and cease with filming.

I don't know about Canada, but in the United States, you can legally record or photograph anyone or anything that is on a public street or visible from a public street WITHOUT permission. And that includes cops. In fact, a Federal court ruled recently that recording police is protected under the First Amendment.

    Oh yeah and if you're going to point out the Boston case with Simon Glik.. That ruling was in the First Circuit Court of Appeals... Illinois is in the 7th, therefore it does not apply. That ruling only pertains to cases in The First Circuit Court.

    There was another case recently, where a cop in Wahpeton, North Dakota arrested a kid for just recording a video of him, by trying to claim that he was "interfering." That cop was given a 5 day UNPAID suspension, and he had to take re-training in Constitutional law. Video recording and photographing police is protected under the First Amendment, period. BTW, that cop was also told that if there were any more incidents like that, he would be fired.

  • It used to be like that here in the U.S. Back in the 70's we had a very liberal justice system and you could get away with holding firm on your rights, but since the conservatives took over the courts you can get handcuffed for looking at a cop wrong. The U.S. is a nation of oppressed citizens who just don't know it until they come face to face with it. What the U.S. needs is another civil right movement. Not one based on race equality but one against police corruption and abuse of power.
