I'd venture to say that he is still alive, but it is indeed one giant gray area as to who is really in control. I believe that Kabuto has control of the Chakra, but he certainly is turning out to look a lot like Orochimaru. The last I saw of Kabuto in the manga he was able to use Orochimaru's Jutsu...

@jascarly123 Hes actually not dead. Hes trapped in a endless genjutsu made by susanoo. I also believe Kabuto has some of orochimaru in him. Well, he looks like orochimaru right now in the manga. Anyway, I doubt someone like Orochimaru will ever die. He even knew the true intentions of Madara.

*Spoiler Alert* Kabuto is actually alive and stronger than he used to be. He looks like Orochimaru (White skin, snake's eyes and the same shape. He made an alliance with Madara so i don't think hes going to die anytime soon. Thought I wish he would because I always hated that character.
