The case of Loving vs. VA only ended the restriction of race upon marriage. A concurring opinion doesn't grant any rights and marriage isn't a right anyway. Gays can form families, but that isn't a right either.

I can marry someone only if that person agrees to it and if legal requirements are met and restrictions overcome. Perhaps 5-year-olds should be allowed to marry too? How about 4 men in a quartet? You stated that polygamy isn't allow, so you ADMITTED that it is a privilege anyway as a person cannot marry more than 1 person.

And wow when you open it up and start actually reading it then put it down and look around for once, what it says becomes even more real. Gays are able to marry, just not to people of the same sex. Heteros, same thing, so gays have the same rights. Why would they do so? Tax breaks, welfare benefits, etc. This is not a human rights issue anyway as there is no right to get married. It's a privilege that people agree to and society allows.

There is no right to marry. If I ask a woman to marry me, she has the right to say "NO!" She must grant that PRIVILEGE and when I ask her I'm giving her an opportunity as a PRIVILEGE. There are also legal RESTRICTIONS(age, not in prison, et al) and requirements that must be met. I don't care what those justices said. The Supreme court also brought us Plessy Vs. Ferguson and Dred Scot. So they can't marry who they love. They can get civil unions anyway. Gays already have ALL the same rights.

Loving vs. Virginia made it a right. Your example about being rejected by a woman is not relevant. Gay marriage is between two consenting adults. That means they both said yes. Plessy Vs. Ferguson was ruled in favor of keeping blacks oppressed- blacks could not sit with whites on the trains. It was destroyed by Brown v. Board of Education. Don't argue in favor of segregation, discrimination, or oppression. Prop 8 took away the right for gays to marry and made second-class citizens.

No, it didn't. It only allowed for heterosexual marriage to occur between people of different races. Marriage is NOT A RIGHT. As for changing sexual orientation, men do that in prisons and it was done in the early Australian colonies, so there is some validity to it. Prop. 8 didn't take any rights away at all. Gays can still get civil unions.

Straights cannot marry of the same-sex either. Straights and gays have the same liberty pertaining to marriage in the same parameters, so legally it is EQUAL already. And my question over whether or not a woman should give me consent first to determine if that PRIVILEGE is met wasn't answered. Marriage is a privilege that two(in some societies more) AGREE to and society permits per restrictions and requirements. Maybe we should allow for uncle/niece marriage as it was done in parts of S. India?

Loving vs. Virginia didn't grant marriage as a right, but only granted that you can't have race as a restriction upon marriage. Marriage isn't a right and never was. Two people have to agree and legal requirements must be met and restrictions overcome. BTW, if we treat it as a right, why not allow for 2 brothers or 3+ people all marrying to each other.

Prop. 8 didn't take anything away from gays. Gays can already marry in the same manner as straights. I can't marry my sibling, 2+ people, my immediate relatives or persons of the same sex either. Legally these rights are the same. There is NO BASIC RIGHT to marriage. Both parties MUST AGREE and legal requirements must be MET. Do I have the right to marry my brother? My niece? 5+ persons at once? No.

Prop 8 "eliminates the right of same-sex couples to marry". I read that phrase on the ballot. If the ballot says so, along with Loving vs. Virginia, along with President-elect Obama, along with the 14th amendment, yeah, it's a right.

No. That case didn't make it a right. A case in 1890 against the Mormons made the definition as 1 man: 1 woman based upon 1500 years of English common law and stare decisis. There is no right to marry. Even if same-sex marriage passes, by your admission, two people would still have to agree and the law would still have to approve after requirements were met and restrictions overcome. My point on Plessy Vs. Ferguson was that I don't hold judges' opinions as sacrosanct.
