Where society's need is great and no other effective means of meeting the need is available, and intrusion on people's privacy is minimal, checkpoints toward that end may briefly detain motorists. In Michigan v. Sitz 496 U.S. 444 (1990), the Supreme Court allowed discretionless sobriety checkpoints. In United States v. Martinez-Fuerte 428 U.S. 543 (1976), the Supreme Court allowed discretionless immigration checkpoints. GET EDUCATED BEFORE YOU GO MAKING DUMB ASS VIDEOS SHOWING HOW STUPID YOU ARE
just so everyone knows... REASONABLE SUSPICION is required to stop and detain someone and PROBABLE CAUSE is required to arrest and BEYOND REASONABLE DOUBT is required for CONVICTION.
Just so you know MR. im so much smarter than everyone. You do NOT again NOT have to have probable cause to set up a checkpoint. UNLESS the sole purpose of the checkpoint is to find criminal activity i.e. stolen goods, transporting of drugs. They didnt inform you of that because i promise you were the laughing stock after you left. hahaha that douche bag thinks hes so smart we told him it was a DUI checkpoint and he still thought probable cause haha. How do i know this?
@spencer087 Dude your not a attorney your probably just a damn paralegal aid who thinks he is the shit. Or like you said USED to be. Let me guess you were doing illegal shit and lost your practice lmao. smh.
Be sure not to call the cops when you find out your neighbor is banging you juvenile kids. Or you're involved in a car accident, or your identity gets stolen. You're a Fucking douche. I'm all about standing up for rights, but police serve a purpose. Leave Ozark if you don't like it. Go to the country.
@ridetotheright1 In 1968 the Supreme court (Terry vs. Ohio) ruled that police do not need probable cause to detain a person. But they do need the lower standard of reasonable suspicion. Really, the first thing you should ask at a checkpoint is, "Are you detaining me? Am I free to go?" If they say you're detained or refuse to answer then ask, "what's your reasonable suspicion for this detention?" And always invoke your 5th amendment right to remain silent. Bravo for standing up for your rights.
up-country police officers...good for nothing, most are fatties full of doughnut and sugar... were it not for the presence of a federal government
(which they hate) and FBI many police units such as these and States would have set up death camps to exterminate people who stand up for their rights, and those who question authority. Check points make America look like India or Zimbabwe. C'mon now we can do better than this...
I commend you sir, for proving that they don't have the right to question your simply being in your car. They did not see you driving until you pulled up to their checkpoint, and had no reason to ask for your identification. Everybody needs to know their rights!
45000 people are killed on highways each and every year and 60 percent are form drunk drivers. That is your probable cause. And to top it off DWI check points have been in front of every state and the US Supreme Court who have ruled that the few seconds you are stopped for a check point are perfectly legal to get impaired driver's off the road. So next time someone pulls a gun on you or commits some other type of crime against you why don't you just go fuck yourself and not call the police.
@TheSkitzophrenics you are right. Why does Ozark need so many cops for? Revenue perhaps? That usually wins out these days over the safety of people. The Ozark police have been an embarrassment in recent years as well, tazering a kid with a broken back while laughing at the press who ask questions about the Ozark Dodge murder.
@ridetotheright1 I live in Springfield too and all the cops here are crooked cops. Did you know most sfpd sell drugs on the side or get paid off from drug dealers. Most of them don't even know the law and the ones that do couldn't give a fuck about you their only their cause they think they can get away with shit. I had a sfpd get in my face with his fist cliched like he was about to hit me and i was like take that gun and badge off and hit me if your gunna hit him Part 1.
@spencer087 Dude you dont know shit. So before you come at me side ways you better get you facts correct alright. And im fine if you dont believe cause i really dont give a fuck.
@ridetotheright1 And he just looked at me and i told him cause if that first punch don't do damage oh don't i feel sorry for you. Ever since my teenage years Ive never gotten such disrespect from cops. They think they are billy bad ass when they aren't. Its kinda funny cause they wonder why the black community hate them so much and im white and im right with them on this subject. # FUCK THE POLICE
I live in ozark. I was actually driving by with my girlfriend after getting food at Arby's and saw this checkpoint being set up. I made the same complaints and my girlfriend was trying to argue with me about it. Unbelievable that they are wasting our time. I literally can't drive through town without seeing a cop.
@shiggashane1 the reason this guy is throwing a fit is because the police have to have probable cause to pull you over and a dwi check piont is not prbable cause they are violating your rights and turning the america in to a police state they are doing exactly what nazi germany did in the begining show us your papers read the pariot act and see how they can coming in you home issue there self a warrant look through all you stuff and lock you upindefinetly with out trial or any of your rights
I wish police would make unannounced visits and searches on the homes of MADD members and check their computers and DvD collections for child pornography even if they have no suspicion that the person is involved in the crime. I am positive they would at least find a few to be breaking those laws or some kind of law which would help justify their warrantless and suspicionless searches of their homes. I mean, its a great cause, to protect children, right?

@fogbubbleproductions you are also wrong. Once again probable cause is not required to operate a checkpoint.
