No, they do not say she was incorrect but rather that the standard to use was not correct.

A judge follow the law, which is codified. To avoid some problem of interpretation, they use some standard. She have followed a first one, like any other judge would have done it.

The supreme court did not say she was wrong but rather that what the judges have been ask to follow was wrong.

For statistical purpose, she been judge in 232 cases, 5 of them been review and she been overturned 3 times. So she been 1.3% of the time, that 60% of the cases reviewed: it's low for a judge since the average, in USA, is 68% of the case reviewed ;)

She took her judgement based on a disparate&disproportionate impact regarding Title VII. And the supreme court put some clarification on Title VII.

So basicly what your saying is she based her decision off what she thought title VII or the 1964 civil rights act said. The supreme court then told her her thinking was wrong. But how did she get it wrong it clearly states "All Americans" not just minorities

No, what I told is that title VII was a bit confusing in some particular application. That was something to happen and that the judgement of the supreme court would avoid other judge to do the same error, a bit because the word "unintentional" was not present before. I also agree with the judgement of Kennedy: their where disparate impact but they was not intentional.

Her judgement was only on the disparate impact, not regarding the intentionality ;)
