As long as you agree to pay off debt and show you're on a low income there's nothing they can do about it. And finally, if debt is 6 years old or more then declare 'statute barred'

As for suing in court, (in USA) if they intend on doing it, of course they can say something along the lines of "we can refer this to court". However, if they don't have intentions on doing a suit, then they can be in trouble. As for the SOL in USA it varies on state to state. It can be anywhere from 4 to 15 years.
In that case, simply 'offer' to pay the bare minimum of what YOU can afford to pay and don't let DCA scum bully you. Ask them what law states you have to pay back debt at an amount you simply cannot afford, and remember to declare a moretarium.
Also, make sure the DCA has proof of ownership of debt before even considering paying these scum bags.

There is NO contract between you (person with alleged debt) and collection agency.
