That kind of gross personal negligence on his part makes it difficult (and in some states, not necessary) to assess Nick’s liability. The fact that John was the adult in the situation and possibly provided alcohol to the minor in question doesn’t really help either.

You cant all blame nick! John had his choice not to wear a seat belt. Nick was wearing his and came out mostly unhurt. If your over 13 then it is that person fault if he/she does not wear their seat belt and not the drivers fault. I do feel sorry for john but its not all nicks fault

I may get flamed for this but Nick was actions were very irresponsible. However John's actions were too. He knew before hand about Nick's reckless driving. Indicating to me that he was willing to accept any of the consequences that happened. He also did not wear a seat belt. Evidence based studies have shown that people who do not wear a seat belt will more likely get injured then those that do. This is very unfortunate that this happened to John but it is not only Nicks fault but his too.
