If they choose, they can do something, i think it would have to be shown that they are being actually harmed by the choice before it would be nullified; or that someone used undue influence. It sounds like the social workers have the undue influence here! abuse of power? If the family and all , perhaps with a few part time services, can help and raise a baby, so be it.

what has happend is they have had a dodgy social worker with a closed mind. Some social workers would find ways around this. The social worker presumes the father/s can't do the job, the gran could help too. The social worker/s should of given them a fair chance. As for marriage. If her partner said can I shoot with with this gun, and she says no, but she says yes to marriage, I would presume she knows the difference.

Something that people rarely consider is what "freedom of religion" really means.That means no law can be made governing the functions of any religion in any way...including marriage. A license infers permission or denial. According to the law, marriage is a religious function, "domestic partnership" is not. Most state's law books freely admit that no law's ever been passed requiring marriage licenses, so why do we have to get them when Constitutionally we don't need them? Ever think about that?

The 1st marriage licenses came after the civil war because people were intermarrying. The reason they gave for requiring those marriage licenses is that blacks were considered to be non human and according to lawmakers they could legislate on that premise. That's pretty sick because most of the "blacks" I know are more human than "I am"...LOL...But sometimes sickness prevails a while. The license itself didn't get popular until they decided they wanted everybody to get one. (in the early 1900s)

The way it all started is the govs of the various states sent a "directive" to the health depts. of the states, requiring licenses. Then to enforce it, they conned preachers into getting licenses by offering them things that were illegal and unconstitutional to give them. But there was a trade off...They have to agree not to marry anyone who doesn't present them with a license, or be fined and jailed. To me, any preacher with a license is a phony and a traitor to his own creator and followers.

Ah sorry - i was unclear. there are a couple of cases running through California cases in a similar vein. the "defendants" also have lower IQ's; but the justification for the removel of the child is down to (unsubstantiated) claims of drug use. Neither parent has been arrested or has ever stood accused on drug charges; but Social Services 'suspects'; therefore they have the 'right' to remove the child.
