My husband (retired Chicago Firefighter) has had to deal w/this kind of discrimination for the past 20 or so years. The men always had to help her carry everything. If you can't do the job, or pass a test, you don't deserve to have the job.

  • Awesome ruling!! Back in 1979 and just out of highschool I signed up a skilled trade apprentiship in Detroit MI. I scored in the top 98% yet minorities who scored much, much lower were accepted into the program. Most of these lower scoring applicants did not remain in the program which created a revolving door. Eventually after 5 years I was accepted into the program. The apprentiship coordinator apoligized up and down but he had a quota to fill..... The BEST should get the job!!!!

Two of the 13 judges on the court criticized the brevity of the opinion. And appellate courts frequently issue short opinions sustaining lower court rulings. There is nothing shocking or out of the ordinary here.

    Is her ruling idiotic? No. Was it wrong? Perhaps. Five of the court's nine judges wrote that the New Haven Fire Department erred. Kennedy's majority opinion, however, said the case posed very complicated legal questions. He's right!!! That's my point as well. Many people think the issues here are clear; they're not. All the judges involved, both conservatives and liberals, should be taken seriously as legal thinkers, including Sotomayor.

  • Have you heard the oral arguments in this case? Of course, you haven't. If you had, you would realize she took the case extremely seriously. She was not the only one who support this one paragraph opinion, a majority of the 2nd Circuit did as well. Again, I don't care if you don't support her, but you should at least have your facts down if you going to malign a very talented jurist.

  • Obama nominated Sotomayor because she's fair. If you read her opinion, she expressed sympathy for the firefighters. But she had to follow the law and precedent, which she has done throughout her career. You should read more before you judge people.

Additionally, you are making this about Sotomayor when it's really about the 2nd Circuit. The Supreme Court reversed the ruling of the 2nd Circuit.

However, it is an insult to Sotomayor and to the judicial process to call the 2nd Circuit decision racist. Reasonable people should be able to disagree without receiving such ugly labels. I happen to believe Justice Kennedy was wrong, but I don't think he's a racist. I don't think he's unqualified for the court. Sotomayor should be given the same respect.

    As many have said... reverse that same saying with a white male making that statement and the nomination would have been thrown out long ago. She may not be racist personally, but her decisions may come out as racial all the same!

    I do believe that MLK would be rather ashamed of her decisions!

  • bigtex501, I actually don't have a problem with the statement. Reversing the statement is a canard, silly really. If someone said: "I believe a wise poor white male from the south...will more often than not make better decisions" regarding this population. I think that's fair. Being members of marginalized populations should give you more insight into the issues facing those populations, and, as a jurist, help you better understand the context of complicated legal issues.

    And in fact Justices on the USSC are often undecided on an issue & I think this may have been a 5-4 decision on this case before the court, but I could be corrected.

    Anyway, the lady is so extremely well-qualified it's hard for me to imagine her not receiving at least 65 Senate votes for confirmation.

  • Sotomayor will be on the Supreme Court. It does not matter that she failed miserably to support her decision to uphold the lower court ruling. The opinion she wrote was one paragraph long essentially just saying the lower court was right. I've never met a lawyer who was able to state their opinion in one paragraph. Guess she thinks it is just her job to have a yes or no opinion. Not an opinion that can be supported by rationale thoughts.

  • I would like to go on record as saying I feel she is wholly incapable of ruling fairly. the Ricci case is a prime example. The city hadn't been sued for the test, no one could prove that blacks were disproportionately impacted by the test (ie. they didn't fail b/c they were blacks), and similar tests had been used to promote blacks before. Sotomayor et al. argued that cities can violate their charters if they fear a lawsuit, and that runs contrary to rule of law!
