If the item in the pawn shop matches the serial number on your police report, the pawn shop must contact the authorities, and provide them with a copy of the identification of the person who pawned the item. Some states require that the pawn shop give you your item back, unfortunately in most states, the pawn shop will only have to offer the item to you for the same price the item was pawned for. After that you will have to seek restitution for reimbursement through the court system.

Back to the video, the only way your stuff would be out for sale is if it had sat in the shop on pawn for 30 days (then there is usually a 10 day grace period on top of that). So no it would be impossible to come in the next day after your stuff was stolen and find it out for sale.

@buyerofsorts maybe you should get your facts straight because the police CAN NOT just take an item stolen or not. The fastest way to get an item back is to reimburse the pawn broker. If not then the person has to wait for the case to go to court and get a judgment stating that the pawnbroker isn't going to get paid but that can take years.

I completely agree. I swore I would never go in one but my friend had pawned some things and I went in with her when she made a payment. she pawned $5000 worth of jewelry, got a $500 loan which she is paying $150 a week on for 12 weeks. basically they are all just a bunch of theives.

Thats great news!! Always keep a list of all your serial numbers and if your stuff get stolen turn the numbers into the police they put them in NCIC and if someone pawns or sells it they get caught, and you get your stuff back.

If possible, mark everything with a secret identification code in a hidden place that thieves will not likely notice. write it all down in a journal. ...then I did the smart thing. I went around to all the pawn shops in my area. The third one had ALL my stuff. I contacted police and they came down. I had my photos and book of identification codes. we matched up every item stolen. This was 2 days after the break in not 30 days. The cops never mentioned to me any 30 day waiting period. But they did charge the owner with more than 100 counts of receiving stolen property.
The pawn shop owner was told by police that if they told them who sold the stuff to them they would reduce the charges. He said he had no record of the purchase. So now he is in prison convicted of about 30+ counts (prosecuter counted the coin collection as one item rather than list coins as individual counts). I got my stuff back. A few months ago I attended his parole hearing. They denied him parole. He is going to do at least another 3 years for a tot of 7 so far.

One should NEVER assume that just because there are laws regulating pawn shops that the shop owners obey those laws. As for me, I would never do business with a pawn shop. They typically pay 1-10% of an items value and you have no absolute guaranty that things you buy are not stolen.

Other than that, the police cars are in the lot because they are killing time, looking at guns, buying their spouses more jewelry, etc. Rarely are they ever here to confiscate stolen merchandise. Out of every 2000 loans, I may get 1 item that turns up stolen from years ago. Often they don't prosecute and I don't worry about it... we want it to go back to the rightful owner.
If you are telling the truth, then you are a rare exception. My conversations with law enforcement tell me that the opposite is true. I have been informed by them that not a day goes by that someone does not sell stolen property at a pawn shop and there are not THAT many pawn shops in my area. I am a musical instrument repairman....i used to do repairs for a pawn shop about 20 years ago (in massachusetts). I stopped doing work for them because about half the instruments had altered serial numbers....for example "3s" changed to "8s" and "1s" changed to "7s"
You show your class nicely Sniper, anyway, you do NOT have to buy you &*^# back. The pawnbroker goes to court WITH you and testifies FOR the state against the thief. Then all items are returned to the rightful owner. ANYONE pawning/selling in a pawnshop signs a contract stating that the item is theirs to pawn/sell, is not rented, has no encumbances, etc.... Check out eBay's and Craigslist's policies on the subject.

Ya my mom did. She had a 5 carrit ring stollen from her that had her name ingraved on the back of it. She found it at the pawn shop. The owner happley gave the ring back to her, and the person who pawned it got arrested.

If the item in the pawn shop matches the serial number on your police report, the pawn shop must contact the authorities, and provide them with a copy of the identification of the person who pawned the item. Some states require that the pawn shop give you your item back, unfortunately in most states, the pawn shop will only have to offer the item to you for the same price the item was pawned for. After that you will have to seek restitution for reimbursement through the court system.

He really needs to be up on the laws. Anything stolen and purchased by a Pawn Shop is still the property of the original owner who had it stolen from them. If they contact the Police, tell them its in a pawn shop, have proof of ownership, the POLICE will go into the pawn shop and TAKE THE STOLEN MERCHANDISE and not give the pawn shop a cent. NEVER pay a pawn shop for something stolen that you have proof of ownership. Simply contact the police. This guy is an idiot making that statement.

Back to the video, the only way your stuff would be out for sale is if it had sat in the shop on pawn for 30 days (then there is usually a 10 day grace period on top of that). So no it would be impossible to come in the next day after your stuff was stolen and find it out for sale.

@buyerofsorts maybe you should get your facts straight because the police CAN NOT just take an item stolen or not. The fastest way to get an item back is to reimburse the pawn broker. If not then the person has to wait for the case to go to court and get a judgment stating that the pawnbroker isn't going to get paid but that can take years.

@RTWSonataRTW Yes, this guy is incorrect. If you find your stolen item in a Pawn shop, the Shop has no rights to it since it was not sold to them legitimately and they technically never owned it. Some states do allow them to demand some reimbursement for restoration costs of certain items, if any. If they unwittingly buy or accept for pawn a stolen item, they lose the item, and there only recourse for reimbursement is insurance or the culprit.

How many pawn shops do I need to visit before I find an honest one? I don't know and honestly don't care. While my experience with pawn shops is admittedly limited, still 100% of that experience has been with dishonest pawn shops. And no, I did not travel all the way to New Hampshire just to prove a point to one person on Youtbube, I was out Christmas shopping with friends and we walked by one, it was spur of the moment. Damn thats $1800 dollars for $500 I don't know where you live but 22% a month is max they can charge in Tenn. also if she is paying $150 a week that is a declining balance loan which pawn brokers are not licensed to do in most states I would check into that. She should have went to a bank or at least a loan company like a credit union pay back on $500 would be something like $800 which is still high but it's far from $1800.

Now I am going to give advice far more valuable than this video. Photograph everything of value that you own. If possible, mark everything with a secret identification code in a hidden place that thieves will not likely notice. write it all down in a journal. Get good locks, a good alarm system, good insurance, and never step foot in a pawn shop except to look for your stolen property.

...then I did the smart thing. I went around to all the pawn shops in my area. The third one had ALL my stuff. I contacted police and they came down. I had my photos and book of identification codes. we matched up every item stolen. This was 2 days after the break in not 30 days. The cops never mentioned to me any 30 day waiting period. But they did charge the owner with more than 100 counts of receiving stolen property.

The pawn shop owner was told by police that if they told them who sold the stuff to them they would reduce the charges. He said he had no record of the purchase. So now he is in prison convicted of about 30+ counts (prosecuter counted the coin collection as one item rather than list coins as individual counts). I got my stuff back. A few months ago I attended his parole hearing. They denied him parole. He is going to do at least another 3 years for a tot of 7 so far.

perhaps there are states that regulate pawn shops more than others. And of course not every business owner follows the law. One should NEVER assume that just because there are laws regulating pawn shops that the shop owners obey those laws. As for me, I would never do business with a pawn shop. They typically pay 1-10% of an items value and you have no absolute guaranty that things you buy are not stolen.

The police are in my pawn store once a week for three minutes to pick up pawn tickets that we've written that week. Other than that, the police cars are in the lot because they are killing time, looking at guns, buying their spouses more jewelry, etc. Rarely are they ever here to confiscate stolen merchandise. Out of every 2000 loans, I may get 1 item that turns up stolen from years ago. Often they don't prosecute and I don't worry about it... we want it to go back to the rightful owner.

If you are telling the truth, then you are a rare exception. My conversations with law enforcement tell me that the opposite is true. I have been informed by them that not a day goes by that someone does not sell stolen property at a pawn shop and there are not THAT many pawn shops in my area. In fact not that many years ago one town in my state got so fed up they attempted to shut them down as criminal enterprises.

At the time I lived in an apartment in a secure building with ADT security and alarms on all units. I lived on the third floor and had a very expensive set of locks on my steel door. Yes you are correct that the more blame rests with the actual burglar but some blame rests with the pawn shop owner because, as the detective told me, if the pawn shop was not there in the first place, the burglar would not have had a ready place to take his loot and would have been less likely to steal my stuff.

Finger prints and photos? They have a good idea much of the stuff is hot. The police here know the law on pawn shops. I see Their cars are in their parking lots 3 or 4 days a week.

All pawn shops should take photos and the fingerprints of the persons who comes in to pawn. Fingerprints alone would discourage thieves.

It's true. I know the law and pawn shops are highly regulated. They must file police reports the items on which they loan and those which they buy. It may or may not be a place to get top dollar but if someone needs money to buy food or pay for rent it's a convenient place to get money quickly. WalMart isn't going to buy your old guitar.

All you douche bags that dont know what you are talking about let me clear it up.A pawn shop is not a place to try and get top dollar for items.Its a business that you go to get a small loan(that a bank wont do) YOUR NOT GOING TO GET what you paid for it RETAIL. ITS A PAWN (LOAN) can't you get that threw all of your thick skulls. Less then 10% of items that come threw a pawn shop are stolen and 95% of stolen items that come in are FAMILY OR EMPLOYEE related you ass whipes!

Hello, is that right what he says near the end, when he says the person that got their stuff ripped off has to pay the pawn shop whatever they have in it, to get it back? That should be the pawn shop's loss and a cost of doing business for them. They need to have a negative incentive to keep them from buying stolen items, otherwise if they get caught, all they have to do is break even. And that's if you catch them before your item leaves their store. Then its gone for good.

I am a musical instrument repairman....i used to do repairs for a pawn shop about 20 years ago (in massachusetts). I stopped doing work for them because about half the instruments had altered serial numbers....for example "3s" changed to "8s" and "1s" changed to "7s"

You show your class nicely Sniper, anyway, you do NOT have to buy you &*^# back. The pawnbroker goes to court WITH you and testifies FOR the state against the thief. Then all items are returned to the rightful owner. ANYONE pawning/selling in a pawnshop signs a contract stating that the item is theirs to pawn/sell, is not rented, has no encumbances, etc.... Check out eBay's and Craigslist's policies on the subject.

Ya my mom did. She had a 5 carrit ring stollen from her that had her name ingraved on the back of it. She found it at the pawn shop. The owner happley gave the ring back to her, and the person who pawned it got arrested.

National Pawnbrokers Association. Well put and to the point. It is true, most law enforcement don't know "pawn law" as defined by each state. Because of each state's regulations most people don't pawn stolen items here because of the "paper trail" that is required. Great Video!!
