Lest we forget whom we're dealing with, Josh Mandel also aired an ad where he falsely implied that his opponent in the Treasurer's race, Kevin Boyce, was Muslim.

Whether it be the unfounded aspersions cast on Mandel's military service by the man in the video or Mandel's own appeal to bigotry in order to win an election, politics has become a dirty & disgusting business populated by unscrupulous men & women.

Actually, it is only if you are speaking in a public meeting, not a public space. As a former journalist I know the rules, and recording and publishing the words of somebody who isn't engaged openly to the public is unethical.

Has this been vetted by attorneys? Even in "one party consent" states, a recording can only be made by a party involved in the conversation. From what I saw, someone could make the argument that this recording is an illegal form of "bugging." The only defense would be that the conversation took place in public. Even then there are a variety of factors that a court would use to determine legality or illegality.
