Need to listen again to news report...the part I heard (had to turn NPR off bec. my kids were in the car and it got graphic) cited: the only crimes worthy of the death penalty are crimes of homicide in which another person is killed.
Well, it was ruled unconstitutional on "cruel and unusual" grounds.
Raping a child is almost as cruel and unusual as it gets. The only, and I mean ONLY, reason why perpetrators should not be put to death is because it gives incentive for them to kill the witnesses; it is certainly not unjust to the perpetrator.

Molesting a child is one of the most cruel offenses in my opinion. If it were my child, I would want to kill the person myself...doesn't matter if the molester is black, white, deaf or purple. I would support the deaf penalty only when there is sufficient DNA evidence. Of course, we could just start dismembering offenders as is customary in some other Countries!
Judging because of what you would for if it was your child is not the way. Besides you have to imagine what signal it sends to child molesters. If a raped child means death well why wouldn't they just kill the child after they rape? These are sick people that do it because they can't help themselves. You get rid of a witness and lessen the chance of getting the same punishment as when you just rape them. They will also not get deterred because they can get the death penalty.
Oops, I forgot one more thing. Now, more and more teens and, if I remember right, children, who commit serious crime, get punished as adult. It's considered as illegal. Yes, your sign for Louisiana is correct. I agree that judges tend to punish African-Americans harsher than do so to Caucasians. Majority of prisoners are African-Americans, even though they're minority. They also punish deaf ppl harsher. A deaf Californian, aged 20s or early 30s, used false identities to collect money by SSI checks and had million dollars hidden in his apartment by the time he was caught by FBI. He didn't spend one cent on that stolen money. (Part 1)

Raping a child is almost as cruel and unusual as it gets. The only, and I mean ONLY, reason why perpetrators should not be put to death is because it gives incentive for them to kill the witnesses; it is certainly not unjust to the perpetrator.
