BearShare is completely legal and does not contain viruses.

However the downloads are done Peer-to-Peer, meaning the files you download may contain viruses, although that's highly unlikely since BearShare checks many files that go through to protect it's paying members.

Also, downloading things on the internet is legal, but if you download copyrighted music, that's where you're committing a crime.
