Usually shoplifting is "settled" because there is a video as evidence. For example, Target would send a "civil demand" letter and the offender could pay a fine to Target in lieu of being charged. But if the offender wanted to go to court (U.S.), they could ask for a jury trial.

Yea, when i got caught shoplifiting, they waited until i left the store because they had no video survaillence, and they took the merchandise from me. they didnt press any charges, but boy my parents were mad, and had to pay a hefty fee...5 months later, the store went out of business.

Hehe...I got caught when I was 15 stealing from Target...they did the same thing. Ironically, I later had a job there when I was 23 in their Assets Protection department catching shoplifters (for 6 months before I got my college degree) . Generally, they'll prosecute only if the dollar amount is a lot or the person doesn't pay the fee.
