The commerce clause does not apply as a rationale when you cannot purchase health insurance across state lines. The statesw regulate auto insurance. However the states also do not compel any citizen through the IRS or fines to buy a car. The tenth amendment applies. Congress has no authority to mandate that individuals purchase insurance. If Congress has no authority to regulate auto insurance why should health insurance be any different?
