I see two problems here. 1. Senator Risch is not a judge and therefore his opinion many not be greeted favorably by the sitting judge in the case. 2. Standing orders dictate that the accused is informed of their Maranda rights and for good reason. It should not be left up to the arresting officer to make the call as to who is given Miranda or not. This could cause huge problems down the road. We need to maintain consistancy.
