However, this man was arrested and is facing up to 10 to 15 years in prison for videotaping one of his encounters with the police; I don’t know if it was this video?? His crime as I said, videotaping the police in public performing their tax paid duty. This man now has Lung Cancer, and the State, the wonder State has been so nice to postpone his court case so that he can receive chemo.

REALize that this Old Man was Arrested for trying to sell ART for $1.00 by 7 well paid PEACE OFFICERS with a Starting salary of $43,104, in a State and nation w/ severe budget problems, The Salary is increased to $55,723 after one year and an additional increase to $57,744 after 18 months. In addition to these base salaries, there is overtime earning, holiday pay, night differential and uniform allowance. PLUS the Cost for the Dispatcher / Jail/ Court/ Vehicles/ Gas/ Insurance/ etc

  • @mizzoo3131 Actually, if you listen at the very end of the recording, you can hear the bucket boys continuing to play, as it is not EVERYWHERE, but in front of MACY'S (or should I say Marshall Field's) that this selling is disallowed, and it was MACY'S that called the law on Chris AND the bucket boys who just went elsewhere where they were tolerated.

  • Also, I'd like to point out the distinction between peddlers and artists - peddlers are merely merchants without a "store" while artists are engaging in First Amendment protected activities - even if they are selling their work. Peddlers have some rights under the 5th & 14th Amendments, but more substantive rights under the Laws of Nations (international human rights). Artists' rights are defined more fully in the US case law, so Mr. Drew has a pretty good chance at a lawsuit.

    to handofdust - interestingly, he was arrested in front of Macy's, who got its start not as a brick and mortar store, but as a street peddler in the Lower East Side of NY.

  • I don't want Chris to have to go as far as to be a modern day martyr. That might be a little melodramatic. I hope, however, that his efforts are rewarded. He was kept seven hours before they told him he was charged with "eavesdropping."

    I'm not happy that the arrest was just boring. I wish that it attracted more attention in a good way. His next court date is the 30th of December at 26th and California. Thanks to everyone who showed up at the hearing today. Let's keep branching out.

People are so inhumane, they wish they could remove any trace of poverty from their line of sight just so they don't have to consider how terrible it must be. The guy is 6 decades old and as far as I can tell isn't menacing anyone.

  • It seems reasonable to be arrested if you refuse to stop peddling--I can't see the first amendment granting a right to set up a storefront and sell things in any public place. The real issue here is that he is being charged with felony eavesdropping for having a running Olympus audio recorder in his pocket at the time, tape recording the event without the consent of the officers. This is an absolute crock and total abuse of prosecutorial and police power that should be condemned..
