Why does the US constitution presume innocence prior to a criminal conviction? Don't bother making a bullshit argument that it doesn't apply to non-citizens. What was the purpose of this clause? Think about it.

If they are guilty, why can't you charge them, convict them, and imprison them lawfully? What is the problem? If the evidence is sufficient enough to prove their guilt to you, then why not have a trial?

evidence may be a problem. they were taken into custody on the purpose of getting information about taliban. nobody thought about the trial and now it may be a problem if to put them at jury. in fact, my suggestion would be to return them into the country of their origin and make a trial down there by local rules.

It isn't "a known fact". The most that was determined during the 911 hearings is that the memo read "Bin Ladin determined to attack inside the United States". It's never been stated or proven as fact that the memo read "Bin Ladin was planning on flying planes into buildings." What you're doing is called "rewriting history".

How many people of your own religion have you personally tracked down for any crimes they may have committed? We created these institutions called "government" and "police" to take on the responsibility of defining crimes and enforcing the law against those who break them. We WANT to prosecute them. We are complaining b/c they haven't been prosecuted and their exposure to torture makes future prosecution difficult if not impossible b/c it calls into question the validity of any confession.

You are either a soldier following the orders of a country or an individual acting on one's own. The former means you are imprisoned until the war is over (not possible with 'War on Terrorism'), and the latter means you are a criminal and should be charged as such. There is no third option that justifies permanent imprisonment without trial.

in fact, internalization of people is well known. remember japaneeses in US and Canada in WW2? still, those were civilians. in Guant, definitely militants though unproven. i don't remember what law or order was issued for internalization but something like that can be made this time, as well. still, i think the best would be just return them into the country of their origin and make a trial there.

Over 110,000 Japanese-Americans were interred, 70,000 of them U.S citizens, meaning the US was their home or country of origin. The govt. has no right to put you in prison because of your ethnic heritage or race. Also, many japanese-americans fought for the US in WWII as part of the 100th Battalion and 442nd Regimental Combat Team

The unit garnered over 18,000 individual decorations for bravery, 9,500 Purple Hearts for casualties, and seven Presidential Distinguished Unit citations. 20 were awarded the Congressional Medal of Honor. All accused criminals are put in custody by law enforcement immediately preceding their trial if they are an ongoing threat to the public. The constitution emphasizes the importance of a speedy trial so that this time is not unnecessarily long, especially since we believe that people are presumed innocent prior to conviction.

A formal indictment is the first step in legal process, followed by such things as plea negotiations, discovery, trial, sentencing, and imprisonment. Currently, they are being held under the ACCUSATION of terrorism or other related crimes without ANY due process.

Where in the declaration of independence does it say human rights are limited to Americans. Do you actually need the constitution to tell you that people deserve a trial prior to imprisonment for 8 years? Regardless, the 14th and 5th amendments state that neither the State nor the federal govt. can deprive any person (not just citizen) of life, liberty, or property, without due process of law. I had to study the constitution to get through law school but I think you should read it anyway.
