Well my answer is, too high; and in any case that it is not a risk Ersland is morally obliged to take at all in respect of an armed robber who is a complete stranger and has just, unsolicited and unprovoked, and in the company of another, just tried to robber him at gun point threatening to take his life.

Shooting someone that is injured, laying on the ground, and is no longer a threat is murder. The initial shot was fine, it was the 5 more that were excessive. The right thing to do would be to take the kid's gun and call the cops and an ambulance. This was a rage killing, plain and simple.

As far as unlikely, that means that there is still some chance, albeit small, that the threat is there. The law says you can use force till the threat is removed. Even if there was a .000000001% chance, that still means the threat is still viable. The criminal was in the business property still, if he was on the sidewalk then that'd be a whole different story.
There's a much higher risk of dying in a car wreck, and he still probably drove to work that day. You can't use that tiny risk as an excuse because you take a much higher risk in several activities throughout the day. You don't go to extremes to avoid them, or even take a minor effort to avoid them.
And no, he doesn't have to permanently flee. But if he's scared, then he should at least stay away until the cops show up. What the law doesn't mention is irrelevant. It's common sense.

Once a person has established themselves a threat, they are still a threat until you can make sure they are no longer a threat.

There is a difference between making sure someone "stays down" and murdering them. Frankly, there's also a huge difference between shooting someone and insanely committing manslaughter. How many bullets do you think it takes to keep one boy from getting up? I'd imagine not more than one (especially if that one hit him in the head)...

Also, people can be shot once and still be a threat, even a shot to the head doesn't necessarily mean automatic death. The only thing murdered here was the pharmacist right to protect himself and MAKE SURE he was safe.

However I will state again, it was a good shoot until the man decided to pump 5 more bullets into him. And it was much more than 30 seconds. He chased and shot at the other boy outside. He then came back and reloaded and shot the boy 5 more times.

I told a family member about this and at first they were like, he did what!? I'm talking likelihood. The chances are slim. The store owner had a higher chance of getting into a car wreck on his way to work that day, and he took that risk. Therefore, using paranoia of highly unlikely situations isn't relevant.

As far as unlikely, that means that there is still some chance, albeit small, that the threat is there. The law says you can use force till the threat is removed. Even if there was a .000000001% chance, that still means the threat is still viable. The criminal was in the business property still, if he was on the sidewalk then that'd be a whole different story.

You can't use that tiny risk as an excuse because you take a much higher risk in several activities throughout the day. You don't go to extremes to avoid them, or even take a minor effort to avoid them.

Once a person has established themselves a threat, they are still a threat until you can make sure they are no longer a threat.

There is a difference between making sure someone "stays down" and murdering them. Frankly, there's also a huge difference between shooting someone and insanely committing manslaughter. Here are my timings 0.35 start 0.42 Ersland gets gun 0.46 Robber shot in head 0.53 Ersalnd leaves store 1.12 Ersland back at store door 1.30 Ersland finishes off robber. So max of 20 outside store max of 55 for whole event max of about 44 between shooting him 1st and 2nd time

@allan3141 now it is 55 seconds. So the kid that he shot in the head was still a threat so he left him to shoot at the other outside and leaving the one that he shot alone with the unarmed employees. THEN he walked RIGHT BY HIM even though he was still a threat lying there in a pool of blood. Is that right?

@dantej32 you are such a dick. He probably never even knew that robber was on the floor when he left the shop. He left via the otherside of the counter with full attention on the other armed robber. There are two more robbers in the car outside. In 18 secs when he got back he had to make a decision forced on him out of the blue, while full of fear and adrenalin. A situation not of his making. You sit back in hindsight and the system takes two years to ponder their decision in comfort!

@allan3141 deal with facts and not "probably". You shoot some one and they fall If he did not know that he was on the floor, why didn't he stay in the shop to protect the other Workers? You are dumb as a box of rocks. fear? fearful of what? A kid lying on the ground bleeding from his skull? There was no threat. He could have stood over the kid at gunpoint and held him at bay until the police got there.
