  • Y'know, if it really came down to it, a massive mob of people in the town where SOPA is being discussed could always just march into the building and make an impassioned speech about how the government is being manipulated by the entertainment industry to do whatever it wants. Or, failing to get inside, form a (peaceful) perimeter around the building, and should SOPA pass, refuse to let the congresspeople leave until they head back in and revoke it.

    The wording here is in such a way to allow for those who would renounce their citizenship by participating in an attack on the US. For example Awlaki (as a citizen)would be a prisoner who can be held, but Joe Blow from Springfield is not.

  • @shaudee67 then Graham needs to read the bill. Section 1032 explicitly states, people's engaged in a terrorist action as outlined under the AUMF. or Authorization for Use of Military Force, ie: Al-Qaeda or anyone who works for Al Qaeda.

  • @theskepticalheretic but that's the thing, there's language here that can be used to say that the requirements be someone who joined al-qaeda and being part of a plot to attack the u.s. (the word 'and' could actually create confusion) on top of that, the secretary of defense can waver the requirements. (after consulting with the secretary of state and others) of course he has to write a paper but who knows what congress will do.

    Here's the deal, if you join Al Qaeda, you have voluntarily relinquished rights as a US Citizen. If you plot an attack on the US for political reasons, you have relinquished rights as a US Citizen. Further on in the bill US Citizens are specifically excluded. I'd have to ask you what your credentials are if you think the word 'and' would radically change the terms of the bill.

  • @theskepticalheretic Why credentials? Do I have to ask yours for interpreting the bill 'correctly'? It wouldn't really 'radically change' it, it could just mean that the word 'and' can be used for the word 'or' like you just did. However I did read the bit that said that it doesn't apply to U.S. citizens from military custody.

  • @Christ724 I'm not saying your intepretation is wrong, I'm simply asking from what basis of law are you saying that "and" would cause confusion in this context. Typically when someone is going to claim something extreme like that they're going to have the credentials and case history to do so.

  • @theskepticalheretic You make some very relevant points. However, I'm left with this nagging thought in the back of my head. Does this rationalize every action that the government takes? Meaning: are there no actions the government can take that should warrant an "attack" by its citizens? Which leads me to my next question: how will our government interpret the word "attack?" Could the Occupy protests be validated as an "attack?"

  • @Zlibservacratican So I think that's a better question, however, in order for any other group, including a known radical organization, like the Aryan Brotherhood, or the Hutaree, to be added as an enemy, the AUMF would have to be modified in the House and Senate. That would take a lot.

  • @theskepticalheretic I could understand that, but I think you may be understating the efforts put forth by those with a vested interest in creating the "police state." The Graham amendment had a huge support from both sides, before it was made "public": the internet found out. What I'm thinking is: all the people in control of making these distinctions have to do is define what constitutes an "attack."

  • @theskepticalheretic Well, bank transfer days could be constituted as "damage to the economy." Also others have argued that the physical occupation of public space has "damaged the local economy." Not to mention the efforts of law enforcement to break up these occupations have drained capital resources, which has been used as an argument against OWS because it is a "damage to the state funds, and hence the economy." I know it's broad, but not impossible nor improbable.

Apparently our last defense is Obama's veto... we're fucked.

  • @theskepticalheretic I get ya, but seeing as how, from my understanding, lawyers and lawmakers (as well as their assistants) need to look at the bills/laws that they are to enforce/argue against, I think such a scenario MAY be possible. But it's a good point you make since, it is speculation on my part.
