    While just adding commentary may not make it fair use, adding commentary certainly makes a stronger argument for fair use, so you are wrong to say "Both videos were equal guilty." I'm also not sure what you mean by "Both." To which other video are you referring and why do you think its infringing?

  • Why is everyone blaming Google, all this about copyright material was always in discotion, and youtube by itself was alredy removing some Copyrighted material, like full metal panic, Saikano and the WWE, and some other stuff, why is google becoming and empire en everybodies mind, so no no one can have money of a born small company, i remember the time when microsoft was a small garage company, but google its never going to have the power MS has, they just sell ads.

  • If all Daily Show clips under five minutes were not taken down, then what the hell happened to almost all of the Even Stevphen clips? Thoes each clocked in at about three to four minutes. Now only two clips remain of my favorite Daily Show segment. What gives?

  • You are probably right about the 5 minute deal, but I'm sure their lawyers probably advised them to do do. As a matter of fact, the "related videos" bar, to the right of the screen, has ALL Daily Show clips- under 5 minutes.

  • Just a comment on the 5 minute line. Well, it seams that it does not exist. One of my TDS clips was taken down, which was only 3:47 in length. Another one, though, 1:37 length, is still up. Maybe they have gone down the ladder to shorter clips now?

  • Its ashame that they pulled the vids off of youtube, because by watching the clips, i really got interested in watching the shows... Now... i dunno... it seems like CC wants their money (as if they dont make enough)i'll lay odds that Stewart and Colbert dont care if their clips are on Youtube... and the clips that are under 5 mins are sure to be gone soon too... i had a clip of a hilarious daily show check in with Colbert that was removed.... and it ran only about 1:20 mins...

    There websites vid viewer is CRAP - its so messy and videos play very badly. CC aren't doing themselves any favours by pulling this kind of thing - they're just gonna annoy the loyal viewers. Bastards.

  • We should support LiberalViewer if it comes to a fight about the take-down of the fair use videos. It's important to keep the right to do that, primarily for free speech reasons, but secondarily for free clip purposes. Everybody think of comments to make in the videos they post of copyrighted stuff. Might be lot more interesting that way anyway.

  • There's also the fact that Comedy Central's website has the "Motherload"; select clips for free streaming. It's got ads on it, so they get revenue. Because YouTube's format is infinitely better, more people chose this site. By removing the clips, we're all going to end up having to either buy clips off iTunes, or watch the dodgy versions at the CC website.

    Back in my day (which I guess is a couple months ago) companies would let the baby have its bottle. At least on YouTube. Fucking Google.

  • Google and Viacom have a video distribution deal. Viacom, of course, owns Comedy Central. Viacom sells Comedy Central clips via iTunes, and so free distribution of clips means fewer people are going to buy the clips off of iTunes and, hence, less ripping off for Viacom. Notice how all of this copyright nonsense hotted up when Google took over YouTube. It used to be only uploads of entire episodes of CC shows were taken down.

  • two obvious reasons for the timing:

    1. there's an election on Tuesday, and the daily show is the biggest political force for the younger generations.

    2.  Google just bought youtube, and their stocks cost about as much as a new laptop. they can't afford a lawsuit.

  • I hope that Comedy Central and other Media Channels realize that all this is free advertising and further positive promotion of their shows, they should welcome posting of sample tidbits of their shows, it helps their ratings/popularity and increases their profits! duh!

  • I have noticed how I'm redirected to the Republican CBS Stations a lot now. How no Political highlights are shown. Now when I go to check video's I'm redirected to a flashing page (very unsafe for epileptics, what's it doing to you?).

  • 3)Then, next day,some of the most incisive segments from 11/1 (Kerry night) seemed to have been taken off Motherload. These are the parts that showed Bush making stupid (naturally) tasteless jokes that belittled the troops and trivialized the fact that there were no WMDs to be found (oopsy daisy, his bad). The clips that are completely about making fun of Kerry are still there.

  • 2) When I finally got to watch the clips from those shows (no tv, no cable) and saw what a masterful job they were doing of, e.g., defusing the whole Kerry situation, I kind of wondered even more--someone did not want something that right on, and also funny, to be seen any sooner?--but thought I was being paranoid.

  • It's not exactly comedy central to blame for this. It's really Viacom, the company that owns comedy central who told YouTube to nix all the copyrighted material, seeing as the others involved with the videos (Comedy Central, Jon Stewart and Stephen Colbert respectively) don't really care.

    1) TDS video clips from the midterm midtacular episodes seem to be being put up significantly later than usual.

  • I find this extremely unfair, because there is no other way to view the unedited versions of the episodes without trespassing into the dark and scary world of copyright infringment. I would be much more accepting of this sudden bad if we the viewers were given the option of buying a DVD with all of the shows. Unfortunately, this option is unavailible, and we are left with trusty ol' YouTube.

    It also got 4 of my videos that I think are pretty clearly FAIR USE

    I found it very disturbing that the other night, I believe I was on during this second round. I searched a clip and they were all up, but as I clicked them they were being taken down.

  • Either I was previously subscribed to too many Daily Show and Colbert Report providers and they were watching my account (Which I believe is highly unlikely and slightly illegal) or it was an incredible circumstance that I stumbled across the clips as they were being removed.

    The several videos of yours that I have watched (One of them I believe that was taken down) have clearly (at least in my opinion) been fair use as has been described by law.

  • Furtermore, the sudden "We're sorry, it's okay, put them back" statement probably means Comedy Central didn't realize how much bandwidth costs, and when they became the only show in town for very popular clips, they couldn't handle it. This is just a guess, though.

  • Comedy Central asked YouTube to pull it's material because their sponsors probably told them they don't want to pay as much for TV ad time if people can just wait an hour and see it on the web for "free."

    While it's not exactly free, you still see YouTube's ads, but those advertisers aren't paying Comedy Central. Comedy Central wants to find a middle ground so they're not losing a ton of money from TV sponsors or if they are, making up for it with web ad revenue.

  • I don't believe in copyright, if you produce a video and want it seen - then just accept that people will share it. And that is what this is really about - they are trying to stop us from sharing media because it takes control/profit away from them. Copyright is bullshit, don't produce if you don't want people to share.

  • have you thought of 1. segmenting the clips into 4:59 and posting several segments 2. putting your comments into a seperate channel for example leave the content in stereo and announce over the left channel so the user can change the balance to the right channel and not hear the left (kind of like karaoke cdsa are encoded)

  • Hi, I really enjoyed your comments on this. I very much wanted you to explore more deeply the timing of this video purging... Is it just me or does anyone else find it mildly suspicious that the main targets of the purge are "The Daily Show" and "The Colbert Report" clips...shows that maintain known progressive or liberal sympathies?   • According to the comedy central advertisement I just saw on TV "You can now get TDS episodes on Comedy Central and no longer have to rely on some crappy blog for clips". A shot at YouTube? Talk about biting the hand that feeds you. I havent watched TDS or TCR for along time, until I started viewing clips on here. Now I watch all the time.

  • I think the videos under five minutes are just safe for now. Comedy Central asserted the copyrights recently because the network execs realized that other networks such as CBS and NBC are taking advantage of director accounts although it is not clear why since there is no apparent corelation between having "official" network uploaded videos and viewer loyalty that translates into a profit.

  • I OWN A MAC!!! therefore comedy centrals' video service is useless to me. Not that i would use it if i could. It is convenient for me to see all my videos in one place. I watch it on tv, i pay monthly for the hook-up, therefore i feel entitled to watch what i pay for in any medium whenever i want. I could have tivo'd for all they know.

    Bottomline-- they are getting free PR as a result of the videos on youtube, and perhaps it's fair for them to get some ad money in exchange.

  • Indeed, the topic of advertising as a cultural, political, and economic institution is far too nuanced to fit into a small comment box. However, if you are still interested, may I suggest Foucault's writings on power, knowledge and discourse or recent literature on intellectual proprty rights. Fascinating stuff!

  • Several things could have caused this: Comedy Central receives ad revenue from hits to their website, "Motherload" and they saw hits to their website decreasing; Google's purchase of Youtube could have expedited copyright infringement proceedings; Viacom could have intervened on Comedy Central's behalf; etc. Ad revenue is a very precious commodity for internet sites and television.

  • Has anyone noticed that TDS segments are fragmented into short sections even on the Comedy Central website? The interview with Bill Bennett for example is posted in its entirety, but split across two videos. Even on CC's own website, it seems to have a 5 minute policy. Perhaps they have some contractual agreement that hinges on 5 minutes, or some kind of corporate policy. They're just extending that same policy to youtube content.

  • I think that the reason Comedy Central is asserting copyright infringement laws now is because after the purchase of youtube by google. More viewers without cable watching CC clips on youtube, the less money Comedy Central gets from cable companies.

  • Comedy Central, owned by Viacom, linked to CBS, linked to Westinghouse, a military contractor with ties to the GOP. They want to reduce exposure to people critical of the Republican party before the midterm elections. Plus, they want to rake in more viewers to cable.

  • Comedy Central most probably wants people to watch The Daily Show and The Colbert Report on there OWN website instead of on Youtube. And I think that Youtube and Google have nothing to do with this particual issue, just Comedy Central.

  • I HAVE noticed this, not just amongst Comedy Central clips. Movie clips and cartoons have been deleted within the last month from my favorites that have been there for months. It's all about the buy-out, I'm sure. Google has different priorities and more to lose if they piss off certain companies.

  • Well Comedy Central paid for the content to be made and had it made for the sole purpose to make money by selling advertising on their shows and to sell their shows as dvd's. They didn't spend their money so some web geek could copy their material and post it to another website that website can make money of their material. We are lucky they let anyone post any length of their material. Maybe you should spend some time making your own material instead of just posting someone else's material.

  • I second that. And not just Comedy Central.There's an awful lot of copyright infringement on YouTube and it's not like there aren't rules for uploading.

  • It's got to be because of Google now owning YouTube in part, because Google already has pay videos. There'll be more I'm sure, and who bets on Comedy Central being one to be one of the next? Clean house, make agreement, sell videos - that simple.

  • The last thing i've watched on comedy central was that WoW south park episode. which I heard about here first. Its much easier to just set the DVR to record than to watch it here. theres better things to do on the internet/with bandwidth.

  • I'm guessing (like many other people) that it's because google purchased YouTube that turned all these companies interested in keeping their copyright. Afterall, if they can sue YouTube now, they'd make a lot of money.

  • In case you didn't know, Comedy Central is owned by Viacom. Before YouTube was purchased by Google, Viacom probably didn't care about the free promotion at YouTube. They didn't care that YouTube carried their content.

  • But now that Google owns YouTube, things have changed. Viacom views Google as a threat and the last thing they want to do is contribute to Google's success/bottom line by providing free content for them. All of a sudden the thought sequence went from "free promotion" to "helping a competitor".

  • Judging by how astute Steven Colbert is about technology (see: Wikiality, Green Screen Challenging), the last thing he probably wants is for these clips to be removed from YouTube.

    Comedy Central probably loves having their stuff on YouTube. Viacom probably doesn't. Kinda shitty but that's what happens when companies care more about their competition than their viewers/customers.

  • Protecting the artist is a scam they use to support their arguments to limit our power. I say it is time for the masses to revolt and seize all the intellectual property in the name of the people. Free Comedy Central You Tube clips for all!

  • Intellectual property, copyrights, trademarks and the like are just a way for the large media conglomerates to control what is communicated and who is able to communcate to the masses. They say it's for the artists, but in truth the artists starve and die poor. Only an elite few ever get rich or make a living. It is the companies and the lawyers who get rich.

  • We won't be giving up much because the protections have been usurped by the corporations, who have the money and the power and the lawyers to steal the art from the true artists. Copyrights have been extended far beyond the time they would be able to protect an artist's rights. And that's for the corps. The protections in their current form are almost useless, except for a very lucky few mega stars.

    The daily show on YouTube was my one true fix of the day.

    And that Motherload video player is sooo crapy, it's just a waste of my time. The whole "let's make sure they watch 3 adds for every minute of video" is ludicrus. The same insipid adds over and over again. It doesn't work on the Internet. There are products I don't buy anymore because their add made me tooo angry on the internet...grrrr ;)

  • I removed all of my videos (non Comedy Central clips) about 3 weeks ago in anticipation of these sorts of legal issues.

    Folks it was a fun ride, but the Google touch of death has descended and the free ride is over. Time to find the next free and easy to use video hosting service...

  • Comedy Central is not the only Studio to take clips off alot from Youtube. I remember Warner Bros. went after clips that their no longer using but claimed it was still thier's. I have a playlist that has daily show clips. And on that day like you said I had to remove about 7 to 8 clips that belonged to the Daily Show from my Playlist. So I understand of what you mean LiberalViewer.
