  • This entire 50 min video can be summed up like this: Cops work for the DA/PA. PA stands for PROSECUTING attorney. That means an officer is only talking to you if he's collecting data in order to build a case AGAINST you. No cop has EVER taken the witness stand ON BEHALF of the defendent. Ever.   • @KnightMD It doesn't matter; they're going to try pinning it on you anyway. Talking to them just invites them to hang you with your OWN words. Force them to work for your conviction; don't do their work for them.

    If you are completely uncooperative, (exercise your rights, don't be an asshole) you have maximum protection against abuse. To the police, "cooperation" means "Waiving your rights." Be polite, but don't give up your rights. Never consent to search, never sign anything, etc.

    Absolutely, yes. If they don't adequately inform a suspect of the Miranda Rights, that person can be released without arrest, or have cases thrown out from that little misstep.

  • Lesson to learn for ALL OF YOU. My friend bought stolen TV. But he NEVER KNOW THAT IT WAS STOLEN. He learn that when he realize... that he know the owner of that TV.

    So what he did ? He inform owner, talk with him and they BOTH inform the Police about this. Person who sold him TV was charged and put away as thief (he stole that stuff and he admit it). But story don't end here. My friend was charged BY POLICE that he committed fencing and he got 2 years in abeyance. NEVER TALK TO THE POLICE!!!!!!

I was picked up by police officers once when I was young because my parents had been in a car accident and my uncle was coming to pick me up (I didn't know). Just sitting in the room had me terrified that I did something wrong. I was racking my brain trying to think of a way to say things that wouldn't get anyone in trouble while also worrying if I was mistaken for some crime. And I was just waiting for my uncle.

He said I'd like to ask you a few questions about a fight at your highschool. So I answered. I saw everything but lied. Them my mom found out and sued them for I forgot but I got some money from it. ;D

If you can show that you're not an ahole who thinks all cops are aholes then you're going to have a pretty good chance at getting a warning. If you can relax and maybe get him to laugh you'll be in a pretty good place too. Just don't move quickly, keep the interior light on, and tell him what you're doing before moving your hands out of plain sight.

  • @Trinith yeah ok, here's the reality. Cops have a quota, you are getting the ticket if they are under. Anything you say to the cop will be recorded and if you attempt to contest the ticket in a court room (which usually gets it lessened or thrown out) you will get it plus a little more thanks to your confession.

However most of what you said is complete crap. I've talked my way out of many more speeding tickets than I've been issued. My only contact with the ABA was approving (or disapproving) their continuing education programs. The ABA doesn't regulate fees, either. What they do is to accredit law schools.

  • @MrSashamesic You misunderstand how the system works in that case. Circumstantial evidence is part of legal reasoning in every jurisdiction I've ever looked at. The burden of proof on the prosecution requires the tribunal of fact (usually a jury) to be impressed "beyond a reasonable doubt," but individual pieces of evidence don't have to meet that standard in the English/American system.

    Otherwise a witness statement wouldn't be admitted if it stated "I think this is what I saw."

  • @MrSashamesic Basically, twelve members of a jury would have had to have been convinced "beyond a reasonable doubt" that he was guilty of all the elements of the offense. Circumstantial evidence is always going to factor in to that reasoning, and -- speaking for myself, and how I would hope that a legal system would be ordered -- I think evidence from a crime victim that a defendant had assaulted her, and THEN from the police that he had made an admission might be compelling.

  • @MrSashamesic It should at least go to the jury for them to decide. It's actually pretty hard to get 12 people to agree unanimously that all the facts are satisfied. If you never ever admitted indirect evidence (that is, non-CSI TV-style hard forensics) how would you ever get a conviction for rape? If the evidence isn't there, the police won't make an arrest, or the prosecutors won't take it to court. It's actually *really difficult* to mount a successful case against an intelligent defendant.
