I killed him stealthily by a poisoned arrow in one hit with my first character before learning you could do that. It actually worked, no bounty or anything, and doing it that way got the dark brotherhood questline started. Better way to do it on the shivering isles though is to kill the orc leading the adventurers against the gatekeepers as he flees the fringe.

Funny thing here is that if you use the console command "resurrect 1" on him, he will then get up. If you then kill him again, he will say "peace at last thank you" even if you already completed the quest.
