Arrest should have been made for failure to disperse. Media members are not exempt from such orders from the Police and he should have left. Film was very poor quality, which suggests he was not a reputable media member. The Officers involved will catch heat because of their using intoxication as an excuse for arrest and then adding resisting arrest. Resisting has a specific intent requrement and a person who is too intoxicated to care for themself, cannot form that intent.

@Blacklemon67a police will always charge you with resisting arrest at a protest because they know there's very little chance any of your witnesses will be taken seriously in court. Resisting arrest and obstruction are what police use to lock up people they just don't like.

@hobo59 It's not speculation, cops do this all the time. There are a lot of policy loopholes they exploit to screw with people they don't like. The sherriff in my hometown is under FBI investigation for precisely this reason. You see, being arrested isn't a bad thing for protesters and the media. It only gives us a legal basis to fight free speech zones, permit requirements, and unlawful law enforcement policies in court.
