If she will win the fight with the university, It will depend on the contract the girl signed when she entered the university (usually the rules are spelled out in the student hand book). Usually no one reads it. Most school rules say; NO booze, drugs, fights, theft, rape then she is out of luck. She was adult when she agreed to contract.
By the way, she has a second problem the school system contracts all have moral clauses.

In fact, both of the universities I attended sold alcohol on-campus [with proper ID.] UCF even had a bar (Loco's) in the student union [along with a Subway]. On a side note, Loco's is one of only 2 places I know of (the other is at Disney World - Epcot I believe) that serve Birch Beer - a soft drink that I really liked. The one Loco's sold was blood red and really strong. Tasted great.

I agree that in general, laws should be passed that would prevent employers (and schools) from meddling in employees' or students' personal lives, but in this case if you read the judge's decision you will find that the school had documented all along that this lady had unsatisfactory progress in the teaching program; no control over the classroom, making up answers to students in class when she didn't know the correct answer, inappropriate remarks to her students during class...etc.

Drinking alcohol is one thing. Being intoxicated or the implication of intoxication is another.
As an educator you assume the position of a role model for your students. I wouldn't want someone who gets plastered and then brags about it educating our children. If they see their teachers doing it they'll think it's ok to do it themselves.
