joe still stole it from a tune called frances limon realesed 2002.Gunther did a cover of a 80s latino song .Amazon dates are not accurate as the say frances limon was released in 2004 but i had it in 2002 so i'm not sure where the get there dates.

You have to play Satriani real low to make this work. The Cold Play drums and rhythm are so much stronger than in the Satriani piece. The second you bring up the level you can hear that the two songs don't SOUND anything like each other. Cold Play probably can show 100 songs that have the same tempo/chords. They are two different songs. The "guitar theory" types are trying to cash in on accidential elements that are on paper, but no normal person can hear.

I seriously suggest "The Plain and Simple Guide To Music Publishing" which I had to use as a companion to my other copyright books in a music copyright course. Basically, fair use applies in this case to a small amount of notes, but it depends on how critical to the new song and original songs amount.
How do you know whether DF recognizes the importance of a riff? While I agree that not all guitarists should be strictly masturbatory in nature, I don't think you have any right to judge a guitarist as being good or not strictly on how good or complex their band's songwriting is.

I actually think this song sounds more like both than Satriani's sounds like Coldplay's. I don't think anyone stole anything. I checked this out because GUITARWORLD mentioned the lawsuit. But now that I listen to it, it's a simple four chord progression. Easily a coincidence. Remember in the movie "Born in East LA" When Cheech is trying to teach a local Mexican band how to play "Twist and Shout" and they started singing "La Bamba" while playing the same exact chord progression? To all the ignorant people out there:" If I could fly" has more than that melody on it, and more arrangements, while the whole "viva la vida" has got the same melody and pattern the entire time. Those are 2 different things, because the judges will believe it is plagiarism not only if they follow the same melody, but also if the band only uses that melody for most of the song, which coldplay does and satch DOES NOT.

Who's the ignorant one Brasker? You are incorrect. Using the melody "for most of the song" is not the legal standard for copyright lawsuits. If you were right then Coldplay has nothing to worry about but the fact is that satch has a legitmate case and that's the reason why Chris Martin has been actively avoiding being served.

Even if Satriani loses his lawsuit he has won as more people have listened to his music because of it. Maybe that is his intention. admittedly it is a little the same but I highly doubt coldplay would deliberately copy someone when they are already one of the most successful bands in the world

wrong coldplay's and satriani's are same ... but gunther's song haven't same partition. In the mix, 3 first notes are same but the rest (80% of the melodie) is different.

Look, nobody but a small group of guitar groupies would have ever heard of If I Could Fly if it weren't for the lawsuit. And the only reason most people listen to it now is to try to hear La Vida da Vita in it. Whatever Satriani's big deal is, that piece of music was not going anywhere. It is pretty boring.
La Vida da Vita blew the doors off for 100 million people. So if Satriani gets some $ out of it, fine. He's still stuck with the guitar groupies.

You have to play Satriani real low to make this work. The Cold Play drums and rhythm are so much stronger than in the Satriani piece. The second you bring up the level you can hear that the two songs don't SOUND anything like each other. Cold Play probably can show 100 songs that have the same tempo/chords. They are two different songs. The "guitar theory" types are trying to cash in on accidential elements that are on paper, but no normal person can hear.

xxdoubledramxx, I tried searching for a good site, but have found little that directly answer your question, but you can google "music copyright and fair use" yourself and look some up if you want. I seriously suggest "The Plain and Simple Guide To Music Publishing" which I had to use as a companion to my other copyright books in a music copyright course. Basically, fair use applies in this case to a small amount of notes, but it depends on how critical to the new song and original songs amount.

How do you know whether DF recognizes the importance of a riff? While I agree that not all guitarists should be strictly masturbatory in nature, I don't think you have any right to judge a guitarist as being good or not strictly on how good or complex their band's songwriting is.

I respect Satriani but this video is right. Coldplay uses very simple and comertial melodies in their songs, and their songs revolve around the same melody played in the intro of their songs. So it is easy they will sound like other comertial people. This is like volkswagen sued toyota for making small cars like jettas. Satriani can't make a monopoly of the chords he uses in his songs.

I actually think this song sounds more like both than Satriani's sounds like Coldplay's. I don't think anyone stole anything. If they ever even heard of each other, I'd bet the whole coincidence was subconscious. This whole thing just made me hate some random guitarist (who isn't bad at all!) I hadn't heard of just b/c he is so egotistical that he sees such a deliberate similarity that can only be explained by Coldplay ripping him off. Backfire much?

I checked this out because GUITARWORLD mentioned the lawsuit. But now that I listen to it, it's a simple four chord progression. Easily a coincidence. Remember in the movie "Born in East LA" When Cheech is trying to teach a local Mexican band how to play "Twist and Shout" and they started singing "La Bamba" while playing the same exact chord progression? Joe shouldn't even bother to sue. ColdPlay will be forgotten in a few more years anyway.
