This was about youtube being against the mirroring of videos when the person wants their videos mirrored right? You could always say you gave everyone the video to be mirrored in an email or something; it would be on the person who made it's hard-drive before and potentially after they upload. While in all likelyhood they will have downloaded, the website cannot assume it has been downloaded before mirroring. If the person doesn't want them mirrored then sucks to be the mirror-er :P

Excellent video, TMA sent me here. You are correct in many points but I want to clarify the download link that some partners have. It is a pilot program and yes I am part of it. I had to apply. I must certify that I possess not only the copyright to the video but also the world wide distribution rights to the video. To enable download I have the option to set it at 99 cents by default or to have it free. Followed up in next comment

Also I have the option of putting it in the public domain, or under creative common license. Because I am an attention whore I select Creative Common License and select the option to let others make derivitave works and to allow commercial use of my content. If you have their permission then it's not a copyright violation. It's only a violation of YouTube's Terms of Service. If you want to avoid breaking the Terms of Service, the best thing to do is ask the copyright owner for a link to download the video from a file-sharing site.
You're right, some of the larger partners have download links where you have to pay for the download, but of course nobody's going to pay for it. That's why the rule is in place.

That download link that you see on WhiteHouse is provided by YouTube, so clause 5B DOES allow people to download videos that way.

1) Rules don't prevent privacy.
2) Some tools like the Real Player plugin for Internet Explorer allow you to download any flash video.
3) As a matter of technology, playing the video intrinsically requires downloading it. Your browser puts a copy of the video in its cache.
