  • Why not make it impossible for inmates to profit from the sale of stories of their crimes and incarceration? The stories themselves may be important to understanding their psychology, but they shouldn't be rewarded for committing a crime.

  • As a general rule I am opposed to rules that 100% deny prisoners the ability to raise money because it creates a mindset of hopelessness and diminishes a sense of self-worth to the point where the criminal could be more dangerous upon getting out than when they went in. The thought of a millionaire convict is repulsive, but a penniless one is a man without hope, and hope is an instrument of rehabilitation. The devil in the details is what percentage should they be allowed to keep., I say < 10%.

  • On the face of it to stop criminals from profiting off their crimes after the fact by writing a book or whatever may seem like a good idea. If 90% of the royalty's from a tell all book go to victim compensation, to prohibit the sale would deny the victim or victims family the ability to receive compensation. Confession and repentance should be the ultimate goals of justice and by dissuading the ability to confess and repent in textual form that goal is undermined.

  • While I haven't yet had a chance to read the entire proposed law, I do commend you on presenting your opinion without resorting to crazy rants or name calling. You presented facts and got me thinking. Might have to watch some more of your videos, because this one was very well done.

  • @LiberalViewer rights will be extended beyond court proceedings in some manner, specifically the right to be treated with fairness and respect for the victim's dignity and privacy. It would likely have to be rewritten to be more specifically worded/narrow-tailored, but it would be worth it in order to help protect them. In addition, while the law may ban criminals from making money off of their stories, it does not ban them from telling them if they so choose. They just can't profit from it.

  • @LiberalViewer or restricting obscenity, laws protecting copyrights and patents... there's a pretty decent list of exceptions to free speech, specifically when it begins to infringe on other people's rights. Currently, as far as I know, victims' rights only exist during the court proceedings, but I don't think that's where it should end. The idea that a criminal is allowed to profit off of his crime is sickening to me, and I don't think it should be allowed. I hope that in the future, victims'

  • @LiberalViewer As for the part about whether or not courts coddle criminals... That's a matter up for debate, but I personally believe they do to an extent, at least in this case. It's a question of balance, and that's why I believe this is a good law despite the Supreme Court's past ruling. Yes, criminals have a right to free speech, but even that has limits, specifically when it starts to infringe on the rights of other people. For example, defamation laws, laws against child pornography,

  • @LiberalViewer of murderabilia entails in a real-world perspective. As for the ambiguity they presented with regards to the legal challenges, they misrepresented that. But at the same time, there is the possibility that that ruling could be overturned in the future by a different set of justices on the Supreme Court (as was Plessy v Ferguson, and as some have suggested for the ruling on abortion, Roe v Wade). A lot of it has to do with the current social paradigm and who is in power.

But it should also be mentioned that while Fox doesn't emphasize the scope of the law, the man explaining the legislation in the middle of your video does accurately explain the scope of the law.   • @LiberalViewer It's true that Fox doesn't provide a perfect representation of the facts in this case, they do make mistakes when they are explaining the scope of the law, but the whole headline issue you were talking about... there's really not enough space there to adequately explain the intricacies of the situation. And this actually may have been an honest mistake, a misreading of the last section of the bill, cause I can't see what the motive behind intentionally misleading us would be here.

They continue to benefit from what they did, their victim is still unwillingly helping them and bringing them pleasure (being an object of their story for which they are being paid,) and victimization continues in that way.   • I oppose the profit of crime stories - at least, crimes such as murder and rape - for the same reason I oppose child pornography. (Before I continue, allow me to clarify that I'm not implying that people who disagree with me would be okay with child pornography.)

    We don't simply outlaw child pornography because child molestation is illegal, nor because of its psychological effects on those who watch it - if that alone were the case, we would outlaw fictional portrayals of it as well. (continued)

  • I think the law is a good idea, but it has to be a little more focused as to what it means by 'murderabilia'. It's never a good idea to stifle anyone's speech at any time for any reason. If a convict can write a book and then get a publisher to pick it up, maybe that's because the story needs to be told.

    The law doesn't just tell them what they can say, it tells you what you can hear. Do you like having what you're allowed to know restricted by the government because of other people's crimes?

    Seriously though, I can see some Constitutional issues in regard to this law. You cited the First Amendment issue.  There is also the conflict with Interstate Commerce. What happens if the inmate has designated that the proceeds go to a worthy charity or to victims of the crime?

  • Both Fox and MSNBC serve their purpose... Fox is doing everything in its journalistic powers to check the power of an expanding government... while, when the Republicans governed poorly MSNBC and pretty much every other Network was there to expose the what the Government had done. It is a good thing to have different news networks with differing biases checking those they disagree with- it keeps all parties sort-of honest. Main problem is much of American news is biased and more factually "news-o-tainment" spending countless hours on some celebrity drunk driving and nothing on.. oh I don't know... the current wars! In fact watching stuff on BBC world news reports way more actual news like Israel / Palestine problems and they actually show Israeli troops throwing Palestinians out of their homes. You do not see that here

  • Fox is slanting the news towards the right no doubt about it. I dont think it is a bad law, it stops curbs down on copycat criminals. Convicted criminals have a constitutional right to their natural rights. They still have their first amendment and may use it as often much as they wish. In an open society like the U.S what if the criminal wishes to voice his opinion on his sentence, it is his right to do so.

    The reason why her daughter's pregnancy mattered was that Palin believes in abstinence-only sex ed and it obviously didn't work too well for her own family. Also, she had announced that they were choosing to keep the baby, yet she believes in taking that choice away from other women.

  • Fox did not say the law gives the victims "any right to stop the sale of murderabilia". The anchor said: "While conceivably a third party could go and obtain some murderablilia on his own and then sell it, the bill Makes It Easier for victims' families to obtain an injunction in court to stop the sale of such items".

    1st, he acknowledges your whole point that 3rd parties are allowed to sell murderabilia; and 2nd, he said "Makes it Easier" not "The right to do so".

Using your logic I can aslo conclude that they are 100% wrong.

  • I feel it is a good law, but that's because I have a heavy bias against criminals. I can't help but feel that a person in prison for a violent crime deserves few rights. I don't have a problem with that criminal sharing their story, but they should not get to profit from it. As I see it, that's almost a reward for committing the crime in the first place.

The citizens purchasing books and "murderabilia" the proceeds of which would go to the criminal, or the government to take people's fundamental rights when they commit a crime?

    When it becomes a crime to dissent against the government and you are convicted, you would no longer have the right to tell your story. Giving away rights is a slippery slope.

    The problem, of course, is that the large number of Fox news viewers vote or take other actions based on the lies and false or misleading information presented on their "straight" news programs.

    When Fox lies (as it apparently does with extraordinary frequency) it affects everyone -- not just their viewers.

  • This is tricky, glad I am up in Canada. But if such a law was to be proposed up here; while serving a sentence they should hold a right to be heard. So the selling their story is kept but Murderabilia sale restricted until their sentences is finish. After they are done their time they can sell all the clippings & hair pieces they want.

    The law say, as you clearly show, "An inmate who knowingly CAUSES to be delivered by mail..." so your argument about an inmate having to mail something from jail is a false argument or an idiotic one. The "CAUSES" part would be up for DEBATE amongst lawyers.

    Sure you can fool a bunch of other idiot libs, but how hard is that really?

    That being said, it's a bad law but doesn't restrict people's SPEECH, just their ability to profit from it.

    Yes. That is why it is a bad law, because it restricts a persons ability to profit from FREE SPEECH. What I think they SHOULD do, is make a law that criminals have to pay reparations to their victims or re-pay a debt to society if they profit off of the free speech that is related to their crime. Like a fine/penalty/or tax.

    I know that is too nuanced and complex for Libs to follow.

  • @TheJapanChannelDcom Lots of them, apparently. I've seen people interviewed at Tea Bag rallies and the like, and they swear by Fox. I also heard people say it's the only news channel they trust.

    Personally, I feel bad for the interns on The Daily Show - they have to watch Fox all the time, and annotate items for the show. I think this borders on cruel and unusual punishment. :)

  • @hystricomorpha even people who are later found to be innocent? you cant retroactively give rights back. the few things that anyone convicted should not have taken away by the people, are their inalienable rights. rights such as speech, and right to life, not being raped, etc. just because they're in jail, there are things they need granted to them, such as not being stabbed or raped :P

  • I dont get it, why do I care about this? People being heinous isnt new, neither, as I understand it, is Fox news complete lack of understanding when it comes to anything legal in nature.

    Meh - seems unimportant to me. It's not like fox is a threat to this particular justice issue. Their bias isnt going to change the law - perhaps the random viewers expectations of it - but expectations of law have very little consequence on law itself.

    Or so I think.

    I mean, in America the penalty for Murder is Death, which means if a prisoner does make money, where's yhe gonna spend it? Maybe his family will get it, so I fail to see the downside in that.

    In Australia the penalty is Life, and Chopper Reid was able to sell a very disturbing children's book. Even the people working at the bookstore near my house felt odd about that, but anyone who wants it has that right. It was NOT in the kid's section though

    It is in some states - not others. And not always even in the states where it can be applied is it pursued.

    Law is not, nor has it ever been an "If -> then" equation.

    It's not "if this is done, then this is the punishment." No two crimes are the same.

  • It doesn't stop them from selling things - it basically stops them from mailing anything at all. Anything MIGHT be sold, therefore nothing can be mailed. So someone wrongly convicted would essentially be denied any chance at attempting to prove they are innocent. It's the worst law ever suggested.

  • As much as I loathe what some people do in the wake of tragic situations, the law seems to be geared towards silencing people, which is a violation of our Constitution. There are plenty of innocent people who have been wrongly convicted of crimes, and need to tell their story.

  • There are places around the world that are ONLY famous because a bunch of people died there, they're tourist traps now. Port Arthur, Tazmania, for example.
