I think the assumption is flawed.. there is no general civil right or statuary right (much less a specific constitutional right) for ANY ONE who wants to marry to be allowed to do so in this country (e.g., polygamists, relatives, minors, etc..) , The state has always retained the right to restrict the definition and boundaries of marriage.

The concern of traditional morality is that over time, and in sufficient quantity gay marriage WILL, ineluctably, alter SOCIAL concepts of normative family structure. Also the law DOES currently modify some abortion rights!
This is why religion is dangerous, it promotes discrimination. Proposition 8 was just a way for religious nut cases to get their propaganda and regulations into the government through democracy. Proposition 8 is although unconstitutional because it violates the separation of church and state and it also violates free speech. It's a shame most of our government is biased and religious (these come hand in hand) and they didn't stop proposition 8 from going through.
