The point is the nod and wink implicit in the speech to those that know and are still chafing from recent judgments (supporting Roe v Wade and daring to suggest we have something to learn from other countries excites outrage in far right), and at the same time purposely obfuscating so it would sail over the head of the majority (repub and dem) who knowing the context, would support those judgments.

As a UK citizen I suggest you let mcain send roe v wade back to the state level, it would be the best thing that happened to the democratic party and american politics in general which is polluted by this piece of judicial activism. (And just for the record I am pro choice) And do not know who this guy his but I fact checked him on his assertion that the US people strongly support RvW, it seems they dont.

McCaine was referring to every outrageous decision the Supreme Court has made like 1856 when they forced a free man back into slavery or 1896 when they upheld racial segregation or 1944 when they supported racial Japanese internment camps or in 2000 when they blocked all states from prohibiting partial birth abortion which IS infanticide. I agree that to "translate" other people's views should raise suspicion but the nature of political language warrant it.
Scott v Sandford is a poor example of McCain' view. If Scott would have won it have been judicial activism as it would have changed the status of slaves. While McCain would agree that it would have been the better decision its judicial activism and that is what McCain wants to keep out of the courts.
