  • @homer30 You are absolutely incorrect. Many Americans misread the 4th Amendment, they leave one important word. Read the amendment one more time, and make sure to note the word "unreasonable." You are protected from warrantless searches & seizures that are unreasonable.

    Thus, if the search or seizure is reasonable, no warrant is necessary.

    See Devenpeck v Alford, Terry v Ohio, or Atwater v City of Lago Vista.

  • My advice don't listen to a damn word he says.

    He keeps telling you to incriminate yourself. The police don't have the right to search your car unless you consent to it.

    If they do a search and you haven't given consent it is an unlawful search and not admissible in court.

    They have to have probable cause, just stopping you is NOT probable cause.

    Provide license and registration and NOTHING else.

    You don't have to answer ANY questions either and just ask " am I free to go".

    While Probable Cause can lead to a vehicle search without a warrant, reasonable suspicion can lead to a frisk of your person (if the facts warrant the officer having any fear that you may have a weapon). This frisk can include the passenger compartment of the vehicle immediately accessible to the driver.

  • I don't know, seems to me you don't really need to mention anything about the weapon. If you plan to use it on them, you don't tell them, that sounds logical. If you do not plan to use it, it makes no difference. Cop has no need to search your car and you don't need to allow it. If your car is searched and they find it, so what, you have a permit for a concealed weapon. Makes sense?

Never roll your window all the way down, so cop’s can look or smell inside, and don’t answer any of their questions, because it’s not in your best interest.   • He means well. Different states have different rules. In Nevada, a license check reveals a ccw permit holder. The law does not mandate that you reveal being armed. It still may be a good idea. Some police use to get nutty. After a deadly mistake, the police got better and more training on how to handle this situation. That included not killing the ccw permit holder.

    Keeping a firearm in your vehicle, such as in the glovebox, is nearly useless. A HUGE percentage of stolen weapons are taken from vehicles. DON'T keep firearms in your car unless they are on your person.

  • There is just one thing I disagree with here. That is that you should automatically tell the officer you have a weapon in your car. If you a CCW, then by all means present that to the officer with driver's license and registration. However, if I did NOT have a CCW, I would NEVER volunteer the info about having a weapon in the vehicle. The only way they could find that out is if they search your vehicle (which you should never give consent to), in which case his/her actions would be illegal.

  • @StevenE1972 So, if your vehicle is searched without a warrant (and/or your consent), it cannot be used against you in court and the charges against you will be dismissed. Don't lie to the cop (just keep your mouth shut), but don't VOLUNTEER information either. There is no law requiring you to volunteer information. In fact, the 5th amendment to the US Constitution says that you have a right to not say or reveal anything at all!

  • Have a machete clipped on sun-visor of my commercial work truck as a tool of my trade… Truck is a toolbox on wheels…Cop pulled me over for running red light and seen machete; cop wasn’t happy. Told cop, machete has many other uses and it benefits me, to keep it in driver’s cab of truck. Told cop I also use my machete to cut & peal fruit as personal eating utensil.

DO NOT LEAVE IT VISIBLE! 2) Officers must be informed, by law, when a weapon is concealed ON YOUR PERSON and you must show him your permit at the same time. If the weapon is properly transported it isn't necessary to inform him. If you do you just gave him probable cause to search your car.

  • @10yearvet, without a permit in most states your transport requires it be unloaded and in a seperate compartment from the driver. Also notification varies from state to state as well, in some states you are required to immediately notify and in others you can wait until they try and ID you.

Ive seen guys beet for having open carry firearms, having cameras, guys just walking down the street. They get charged with nonsense crimes, the prosecuter drops it and nothing ever happens. That why I say I would never show the cop my gun (absent a law as a1986v65 pointed out)

  • I would NEVER tell a cop I had a concealed weapon, EVER. These guys are all too often trigger happy ego maniacs. Most aren't but enough are to where you could be in a world of hurt for no damn reason if you piss off that cop. And an armed citizen can be all it takes to piss the maniac off, and when he beats your ass and throws you in jail and you're charged with 3 felonies, the only thing anyone will care about is what that cop says. And a lot of them are liars, so good luck with that. 

  • @mmagnus09 I have had a CWP for over eight years, been through many safety checks and a couple traffic stops. I have always informed the officer that I am carrying a concealed weapon and show him my permit with my driver's license and have NEVER had any problems. One officer asked me what caliber my weapon was. I told him 40 cal. Glock 27 and all he said was "nice gun".

  • I was stopped one time at intersection of road check. Had my two rifles on rack at back of window inside of pickup truck. All he ask is driver licenece and no question. Yes, he did ask what cal. the rifle are. 30-30 and .308. He told me he had once own the 30-30. We talk about two min. before another car came behind our truck. We left with smile. Noted: the clips was not on weapon and was lock in case.

    as for your best interest, they may not be representing YOUR best interest, but remember this, if a officer pulls you over or is doing traffic work, its because its what the community wants. There are 300 million people in america and most of them want the cops to write tickets.

  • @blackfalcon1324 the tickets are absolutely fine, they are non-enforcable offers to contract and can be dealt with very easily by conditional counteroffer. Let them write as many as they want. Only an idiot would pay them or even take them seriously. What 'most normal people want' reflects the state the world is in today. So because 'most people' want something, it doesn't make it sane or right.

    With regards to your rights, you have all the rights provided you know them and you can assert them.

  • If he still refuses to identify, ask which police station he/she works at and what is the phone number there or directly dial 911 and report the issue, give the man's number and ask for his name. Be civil, there's no need to get emotional, that's exactly what he/she is waiting for.. If they do identify themself, ask 'Why are you accosting me sir/madam?' also inform them how much you charge for your productive time they are taking. 'Do you have a bona fide claim against me?'

  • Before you say anything to the officer, wish him/her a good day and ask them 'Who are you?' If they say 'Im a police and that's all you need to know' don't settle for that and insist on seeing their identification. If they get funny, as they will, they don't like to be PERSONALLY responsible for their actions.. insist 'Are you refusing to identify yourself?' If they start threatening, that's a crime! Ask 'Are you threatening me?' and 'May I suggest you call your supervisor NOW!'

  • Put both your hands out of the window palms facing up and say, officer, I have a permit to carry a conceal weapon. The officer most likely will ask, are you carrying one at the moment. You answer yes if you are and you tell him you will follow his instructions to secure the documents he needs. This way, he will not shoot you in the ear. Ohh and in some cases, carrying a conceal weapon gives the officer a better understanding that you are a responsible person which may lead to no ticket
