Yoruichi WAS a captain of the Court Guard squads until she saved the shinigami turned into vizards by Aizen, Tessai, and Kisuke from being put to death unfairly by a hypnotized Central 46. See the episodes starting at 206 if you want to know more.  She's been accepted back into Soul Society but hasn't been re-instated as a Captain yet. She may prefer to operate as an independent. And why would she need a sword when she is the MASTER of kido? She never uses a sword except in flashbacks.
