Sunstein then says that he believes that within the next 3 years the court may well rule on that and rule that the individual does have an individual right to bear arms.

He was right, on June 29, 2010 that Supreme Court did rule in McDonald v. Chicago that the right of an individual to keep a bear arms is fundamental. That is what Sunstein predicted would happen and that is what happened.

Nowhere did he predict that the right to bear arms would be overturned.

Sunstein says that prior to 2007 the US Supreme Court had never voiced the opinion in a court vote that the 2nd Amendment to the Constitution held that an individual had the right to bear arms as a individual. That it just the case. The court had not stated the an individual did not have the right to bear arms as an individual. In that sense in 2007 the court opinion was in an "unsettled" state.

We finally had a Court in place that would not dodge the question and settle the matter. (the liberals knew that if they decided against private ownership the backlash would likely tear the country apart and so they simply avoided it in favor of the vague Miller case.

Anyone interested in the Supreme Court history regarding firearms ownership should read US vs. Miller which is the only case the Court heard on firearms ownership prior to the recent case showing an individual right. Miller was a bootlegger charged with violation of the tax imposed on a sawed off shotgun he possessed. He won in the lower court but did not show up for the Supreme Court hearing.
