only if you use a stick as a weapon is when you will go to jail. this guy is, because he obviously used his stick as a weapon, Bertuzzi didn't, because he didn't use a stick (a stick is WAY more deadly in hockey than fists can be). Remember Marty Mcsorley? He went to jail because he slashed brashear in the head. but if he would have pulled a bertuzzi, he just would have been suspended and possibly fined.
