What drives a person's "morals" to make a showing like this where he is supposedly defending the rights of citizens against unlawful search and seizure -yet he votes for this monstrosity to the sanctity of Western Law in regards to the indefinite detainment of US Citizens deemed "enemy combatants" by the military? On US soil? What is it in a person's upbringing that evidently gives them the want to do things like this to so many? Our system has failed and if everyone doesn't stop it, we're dead.
The rules that all forms of govt. refer to are quite clear. What citizens are forced to abide by must be interpreted by a lawyer. How come?? Terms like: each case is unique, state laws may vary, laws may change from time to time, you may be detained for a "brief" period of time, traffic stops= every car, every 3rd or 5th car, border patrol stops 75-125 mi from any border, dui check points that also check registrations, inspections, insurance cards, etc. Why aren't our rules as clear as theirs??

2.) People talking on the phone have a REASONABLE EXPECTATION OF PRIVACY. After 9/11, I'm afraid an expectation of privacy at the airport might not be so reasonable.

What drives a person's "morals" to make a showing like this where he is supposedly defending the rights of citizens against unlawful search and seizure -yet he votes for this monstrosity to the sanctity of Western Law in regards to the indefinite detainment of US Citizens deemed "enemy combatants" by the military? The rules that all forms of govt. refer to are quite clear. What citizens are forced to abide by must be interpreted by a lawyer. How come?? Terms like: each case is unique, state laws may vary, laws may change from time to time, you may be detained for a "brief" period of time, traffic stops= every car, every 3rd or 5th car, border patrol stops 75-125 mi from any border, dui check points that also check registrations, inspections, insurance cards, etc. Why aren't our rules as clear as theirs??

The Warren Court set this standard in 1961 (Mapp vs OH). Under Nixon-Burger, Regan-Rehnquist, and now Bush-Roberts, "I didn't know the warrant was illegal" became an excuse. Only if the prosecution can prove such evidence would have been obtained legally should such evidence be admitted.

1.) People who choose to fly KNOW THEY WILL BE SEARCHED. You can choose not to wear your crotchless panties to the airport, but you might reveal embarrassing or sensitive information in a "private" phonecall.
2.) People talking on the phone have a REASONABLE EXPECTATION OF PRIVACY. After 9/11, I'm afraid an expectation of privacy at the airport might not be so reasonable.

You also realize that the gov is trying to restrict your use of video recording so you need permission of every one to record. So if you are in a public park with lets say some one threaten to beating you up and manage to record that you may find your self in jail for recording it.

@F4O4U4R4S actually i've been reading up and, much to my chagrin, he's kind of an asshole. he certainly has not stood up for the bill of rights. not only did he vote to extend the patriot act, he voted against amendments aimed at protecting privacy and restricting domestic spying to suspected terrorists (the durbin feingold amendments).

However, the article claims this may be the first time the aclu defended gun rights so I was not wrong until last month in my views of the aclu. I have not changed my views on franken though but I hope he proves me wrong as you have.

You display an extraordinary lack of knowledge pertaining to this subject. There is only one branch of the government that can make laws. The president can issue executive orders, and retains other powers; but only the legislature can make LAWS. That would be the bicameral system we call congress. Sen. Al Franken, is a Senator.(That is what the "Sen." title stands for.) He can actually write and submit laws to congress. Justice department lawyers on the other hand, CANNOT!

There is quite a lengthy process of reconciliation and discussion before a BILL becomes a law, and of course my dear president Barack has to sign it or leave it alone for ten days. But perhaps again you are correct, and I am unfamiliar with the process. Would you be so kind as to explain said process to me? Law school classes are just not what they used to be, you understand right?
