    what i mean is if i turn on my tv and see a lady gaga video, then i should be able to tape that and put it online. because i just turned on my tv and it was there. once its made public then anyone who wants to should be able to copy it .

    can i copr right my face so when i go to the bank and their security cam reproduces my image i can sue.

  • As much as we would like to say their point was valid and it was Youtube's fault, it's not. It's Viacom's spilled milk and now they are trying to clean it up. The privacy act doesn't permit them to take legal action against the users, that's between them and Google's legal associates. At any rate Viacom thinks they are above the law and if they did try to retroact against anyone, you could find many lawyers to take your case. it is gonna cost Viacom way more than they could ever gain.

  • We really should have little to worry about. Think of all the copyrighted material downloaded from Kazaa or Limewire back in the day. If "they" had any right to go after the users of those agents. We would have been hearing similar issues years ago. As much as Viacom is peeved, it's really their own faults for not doing the smart thing and creating their own channel. Lots of music companies have their own channels and post their own content and commercials their.

I uploaded a home video clip that happens to have a radio in the background playing. Would a 'radio' playing be infringing? That 'fair use' grey area i don't understand.

    And as far as LiveVideo goes, I found one of my videos on there recently and filed a complaint to have it removed - had to go a couple of rounds with them before the took it down.

    Okay, wow - 13:26 and I sat through all of this easily in one sitting. That doesn't always happen, so you must have some mad skillz.

    I don't understand why it would 'hurt' them for people to make for example, sims 2 music videos from a song they like, or having a song play while they are drawing a picture. I understand if these companies don't like 'how' their content is being used in the movie, but they already have the power to have those videos removed...and I can't believe a little fan music video would hurt the artist.

  • Great points! I notice the YouTube statement you linked to isn't really saying much to the point while the Viacom statement is clear-cut and lays it out in a pretty concrete manner. There's not much in it I could dispute nor I think could YT or anyone else who's been on YT more than a day.

    Viacom's right on this and I just hope we users don't get thrown under the bus when YT scrambles for cover, but I suspect when it gets too hot we WILL be.
