you can change the key, so the rubinoos song could've been done, say, 2 full keys higher and E and B would've been different (G#, D#) and avril could've kept the E-A-B-E progression, therefore she (or her songwriters? *gasp!*) didn't steal the chord progression, but the choruses do sound quite similar, only kinda obvious
