(1)The FBI never stated Bin Laden was NOT responsible for 9/11, there just wasn't enough evidence to indict him.

(2)Al Capone and Carlo Gambino were never convicted for their violent mob crimes because it's hard to prove that organized crime bosses are directly involved in their gang's crimes.

Because that would be speculation. So what if Bin Laden knew nothing about 9/11? We have proof of his involvement in other terrorist activities. Also, lack of Bin Laden involvement doesn't mean the attacks weren't perpetrated by Muslim terrorists, or even that they weren't planned by Al Qaeda. Bin Laden was living in Afghanistan at the time. The hijackers were from Saudi Arabia, UAE, Egypt, and Lebanon.
